Box 1594 Clayton, NC 27520 Subject Property: The Vineyards At Tuscan Ut to Marks Creek [030402, 27-38, C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Thompson: On September 3, 2008, the Division of Water Quality (DWQ) received your application dated August 30, 2008, with additional information received from you on September 9, 2008, to fill or otherwise impact 78 linear feet perennial stream impact, 70 linear feet intermittent stream impact, and 7,200 square feet of Zone 1 Neuse River basin protected riparian buffers and 4,000 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed residential development at the site. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will place this project on hold as incomplete until we receive this additional information. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide building envelopes for all lots with wetlands, streams or buffers on the site plans. 2. Per the requirements of the Neuse River Basin Riparian Buffer Rule, you must show that this site meets diffuse flow requirements with a level spreader or other BMP per Chapter 8 of the BMP Manual (see http://h2o.eni-.state.ne.us/su/bmp fonns.htm). 3. Please provide stream determination documentation on the site (upstream and downstream photos and DWQ stream identification forms). Please submit this information within 30 calendar days of the date of this letter.
