REGAN Secretary TRACY DAVIS Director This letter is in response to your April 7, 2017 letter requesting the that your company be allowed to remove the rock dam located within the diversion channel and allow drainage to be diverted into the stabilized channel. This request is hereby approved and is contingent upon the following: the construction sequence outlined in the April 7, 2017 shall be followed. Operating Condition No. 4D (1) has therefore been satisfied. Please attach this approval letter to your existing mining permit for future reference. The expiration date, mine name and permit number on the permit document shall remain the same as before this modification. The issuance of a mining permit and/or any modification to it does not supersede local zoning regulations. The responsibility of compliance with any applicable zoning regulations lies with you. As a reminder, your permitted acreage at this site is 380.5 acres and the amount of land you are approved to disturb is 293.2 acres. State of North Carolina 1 Environmental Quality i Energy.
