Murray North Carolina Depariment af Transpartation 2612 North Duke Street Burham, North Carc�lina 27704 Dear Mr, Murray: This letter is in response to the May 23, 2017 request fram the North Carolina Department of Transpartation (NCD(�T) for concurrence with a biologicai canclusian that the replacement of Bridge No. 12 on SR 1105 over Long Creek in Vance County may affect, but is not likely to adversely affect the federally propased threatened yellow lance (Elliptio lancealata). The US Fish and Wildlife Service (Service) previously provided concurrence for the federally endangered dwarf wedgemussel (.4lasmidanta heterodon} with a letter dated January 5, 2016. These camtnents are pravided in accordance with Section ? af the Endangered Species Act (ESA) of 1973, as amended {16 U.S.C. I531-1543}. According ta in%rmation provided, mussel surveys were conducted at the praject site on September 2, 2015 and November l, 2015. Cumulatively, the surveys extended 100 meters upstream and 400 meters dowr�stream of SR 1105. Na yellow lance mussels were observed. Unly 3I specimens of Ellipt�o camplarrata, a very common and #alerant mussel species, were observed. The mussel habitat quality observec! within the survey reach was less than optimal, and a sma(1 wastewater discharge pipe approximately I50 meters downstream of the bridge further degr�ded the habitat quality. Based on the mussel survey results and t�ther avaitable infortnation, the U.S. Fish and Wildlife Service concurs with the NGD4T conclusion that ihe propased bridge replacement may affect, but is not likely to adversely affect the yellaw tance. We beiieve that the requirements af Section 7{a)(2} of the ESA have been satisfted. We remind you that obtigatians under Section 7 consu[#ation must be reconsidered if: (1) new infarn�ativn reveals impacts of this identified action that may affect listed species or critical habitat in a manner nat previously considered in this review; (2) this action is subsequently modified in a manner thai was nat cansidered in this review; or {3) a new species is Iisted or critical habitat determined thak may be affected by this identified actian. Murray North Carolina Department af Transportatior► 2b12 Narth Duke Street Durham, North Carolina 27704 Dear Mr. Murray: This letter is in response to the North Caralina Department af Transportatian's (NCDOT} request for concurrence with a biological conclusion that the replacement af Bridge No. l2 on SR 1105 over Long Creek in Vance County may affect, but is not likely to adversely affect the federally endangered dwarf wedgemussel {Alasmidonta heterodon). This request for concurrence was included in the January 2016 Natural Resaurces Technical Repart and in a January 4, 2016 emaiI from you. The NCDUT has concluded that the project may affect, but is not Iikely to adversely affect the dwarf wedgemusseI. These camments are provided in accordance with Section '7 aFthe Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). According to information provided, mussel surveys were conducted at the project sita on September 2, 20I S and November l, 20l 5. CumulativeIy, the surveys extended 1 QO meters upstream ar�d 440 meters downstream of SR 1105. No dwarf wedgemussels were observed. �nly 31 specimens oi Elliptio complanata, a very comman and tolerant mussel species, were observed. The mussel habitat quality observed within the survey reach was less than optimal, and a small wastewater discharge pipe approximately 150 meters dawnstream of the bridge further degraded the habitat quaiity. Based on the mussel survey results and other available information, the U.S. Fish and Wildlife Service cancurs with the NCDOT conclusion that the proposed bridge replacement may afFect, but is nat lilcely to adversely affecE the dwarf wedgemussel. We believe that the requirements of 5ectian 7(a)(2} of the ESA have becn satisfied. We remind yau thaE abligations under Section 7 consultation must be reconsidered if: (1) new information reveals impacts ofthis identified action that may affect [isted species or critical habitat in a manner not previously considered in this review; (2) this actian is subsequentiy modified in a manner that was not considered in this review; or {3} a new species is [isted ar critiaal habitat determined that may be affected by this identified action.
