Mr. Rubino:
Thank you for your inquiry. I think your understanding agrees with that of the EMC, which was captured in the decision.
On page six of the decision you will see a statement that the EMC specifically is not requiring mitigation and on page 7 you
will see that the only condition for the variance is related to stormwater diversion.

I just received a copy of the DWR Buffer Zone Major Variance (attached here). There is a revision that I would like to
request related to mitigation. I do not believe this is an appeal, since this was an item specifically discussed during the
hearing. As for NCDMF payment for in -lieu impacts for compensatory mitigation, this requirement was waived during the
hearing. A motion was made to waive DMF payment for mitigation and was unanimously supported by the Commission
members present. Please let me know if this is consistent with your understanding. Feel free to call or email me any time
to discuss. Thanks for your attention to this matter and for working on this project with us.
