I think your understanding agrees with that of the EMC, which was captured in the decision. On page six of the decision you will see a statement that the EMC specifically is not requiring mitigation and on page 7 you will see that the only condition for the variance is related to stormwater diversion. There is a revision that I would like to request related to mitigation. I do not believe this is an appeal, since this was an item specifically discussed during the hearing. As for NCDMF payment for in -lieu impacts for compensatory mitigation, this requirement was waived during the hearing. A motion was made to waive DMF payment for mitigation and was unanimously supported by the Commission members present. Please let me know if this is consistent with your understanding.
