This correspondence is in reference to the Dredging and Spoil Disposal Area Management
Plan (Plan) for the Sandy Point Development located on a 930-acre tract of land, located off N.C.
Highway 32, adjacent to the north shore of the Albemarle Sound, southeast of Edenton, in
Chowan County, North Carolina. The plan was submitted to this office on your behalf by Brian
Rubino of Quible and Associates during our meeting on September 5, 2008. This plan was
submitted to comply with Special Condition 2 of your issued permit which requires that a written
plan be submitted 60 days prior to commencement of dredging activities in the project area.
According to the submitted document, hydrologic dredging will be conducted by Mr. Darren
Burris with Cape Dredging Company, Incorporated. Spoil disposal will occur in approved high
ground disposal areas shown on the revised plat titled Sandy Point Development CAMA Major
Plat revised 09-03-08 Dredge Spoil Disposal Relocation. Permit Special Conditions numbers 9
through 17 refer to spoil disposal and excavation activities. These conditions remain in effect. In
addition, if additional impacts occur outside of the permitted channel alignment, resulting from
anchor drag or any other activity associated with excavation or spoil disposal, these impacts must
be reported to the Corps of Engineers immediately and remedial action must be taken. Effluent
must be monitored and appropriate actions taken to ensure that turbidity levels do not exceed 25
NTU. Any change in activity or violation of permit conditions must be reported to the Corps
immediately.
Thank you for your time and cooperation. If you have any questions, please contact me at
