Subject: BUFFER EXEMPTION
The Fourth Ward-606 Dorthea Drive

Dear Mr. Martin:
On May 25, 2017,the Division of Water Resources (Division) received your email dated May 24, 2017,
requesting clarification of the buffer rules for the subject project.
Upon review of the proposed project,the Division has determined that this activity is considered an
Exempt Use, per the Table of Uses found in 15A NCAC 02B [Neuse] .0233(6) as a "STATE THE USE PER
THE TABLE OF USES".
The existing impervious area within the buffer is exempt from the Neuse Riparian buffer rules and when
the site is redeveloped other impervious surfaces can be-within that same footprint without a written
authorization from the Division of Water Resources.Also,the existing lawn can be maintained as lawn
and that those activities necessary to either maintain the lawn or prepare the area for planting trees
and shrubs are exempt activities.
This exemption is only valid for the purpose and design that you described in your email. If you change
your project, you may be required to apply for an authorization and/or variance.
This exemption does not relieve you of the responsibility to obtain all other required federal, state or
local approvals.
