Please see our responses below. 1. We have assembled this brief narrative below describing the minimal adverse environmental effect(for the waiver request): Within the project area, approximately 8,060 square feet of palustrine forest wetlands have been delineated. Of this existing wetland area, only 2,030 square feet(approximately 25 percent) will be impacted by construction. Only 200 square feet will be permanent impacts, comprising only 2.5 percent of the delineated wetland area.All areas listed as temporary impacts will be revegetated with regional, hydrophytic vegetation in order to promote regeneration of the wetland. Planted woody material will be at least 2 years of age to ensure quick establishment and an eventual return to the pre-construction,forested site conditions. Tree protection fence will prevent unnecessary tree removal/damage. After completion of the proposed project and re-establishment of vegetation, temporarily impacted wetland areas will continue to perform beneficial, ecological functions, including groundwater recharge,filtration and storage of pollutants and suspended solids, carbon storage, nutrient cycling, wildlife habitat, and flood attenuation. In addition, the stable stream channel will maintain floodplain connectivity and provide stable conveyance of storm water. In summary, the proposed wetland impacts will result in no more than minimal adverse environmental effects based on: the minimal amount of permanent wetland impact; the reforestation of temporarily impacted wetland areas, which will maintain the ecological function of the wetland;and the improved channel form/function resulting from the proposed streambank stabilization. 2. Regarding the slope of the cross vane arm, we have further evaluated the constructability of the structure (based on the channel size vs.the boulder sizes) and feel comfortable narrowing the slope range to 12-18%. The actual constructed slope will depend on the available boulder material and field conditions during construction. We have revised the relevant plan sheet and have attached it for your records. 3.Additionally, we noticed a minor error in the legend of the impact exhibits. We have attached a revised version of the impact exhibits for your records. The revision does not affect the size of the impacts; we only adjusted the patterns in the legend to be consistent/correct. The project involves discharge of fill into a special aquatic site,wetlands,as part of the stabilization project. Per the NWP 13,section (d) below,this activity requires a waiver. Please provide a brief narrative describing the minimal adverse environmental effect to support a waiver request. (d)The activity does not involve discharges of dredged or fill material into special aquatic sites, unless the district engineer waives this criterion by making a written determination concluding that the discharge will result in no more than minimal adverse environmental effects; Additionally, I have a question about plans for the cross vane shown on Sheet 7. The slope for the vane arm is 4%to 20%. Is this range typical? I usually see smaller variations in ranges for these structures. Can you explain?
