If they can re -design the parking lot and building and keep the impact under .10 acre they may not have to buy credits

Ms. Turner,
I've reviewed the Kia -Mazda of New Bern PCN that was submitted to this office on May 9, 2017.
The NWP 39 request is for .39 acres of fill. The avoidance and minimization document that you submitted only mentions
the reason why the existing Kia and Mazda buildings and parking lots are going to be expanded. It doesn't mention how
the wetland impact has been avoided or minimized. Can the proposed building and parking lot(s) be re -designed to
allow for a smaller wetland impact? Can additional neighboring "upland" land be purchased that would also minimize
the wetland impact?
In the PCN you mentioned that 0.4 acres of wetlands will be purchased from "Brices Creek Mitigation Bank". Have you
contacted the mitigation bank to ensure that they have the 0.4 credits available for purchase? Can you also send me any
documentation or transcripts that you have with Brices Creek Mitigation Bank on this project.

The developers reviewed other scenarios to avoid and minimize wetland impacts. The Kia
building size and location is the key factor involved in this wetland fill request. The building size as
shown in the drawings and configuration cannot be modified due to Kia's development standards. Kia
provides the owners standardized floor plans and building elevations with sizes based on the demand
and sales of the dealership and there are to be no deviations in the appearance or shape of the building.
Different building locations were reviewed to determine any avoidance or minimization to the
wetland impact. The location of the Mazda building is fixed given the existing building is proposed to be
modified, updating it to the current standards.
Option 1: Shift Mazda and Kia building north — The Mazda building location is fixed (modified
and renovated in its existing location) and therefore after providing a 30' safety and fire access
between the buildings the Kia building cannot be shifted any further north.
Option 2: Shift Kia building east—The proposed location of the Kia building, because of its
depth, is positioned to provide truck access around the rear of the building. There are
service/shop entrances, located approximately 50' from the rear, on the north and south sides
of the building that must be accessed by large tractor trailers to unload heavy parts. The
proposed front wall is approximately 45' from its existing location. Shifting the building further
toward Highway 70 will block the north and south traffic flow of the development and reduce
fire access to the front of the building. The Kia building frontage also aligns with the Mazda
renovation.
Option 3: Shift Kia building south — Given the Mazda building is a fixed location, the proximity of
this manufacturer to Kia is crucial for the day to day operation of the facility for both sales and
service. The service center is shared between the manufacturers and there are common sales
employees between them as well. The Kia building would need to shift 200-250' south to
potentially decrease the wetland impacts, but at the cost of vehicle display area. This shift
impacts the location of the required storm water pond, which would then need to be sited
elsewhere on the property. This option would cause the loss of 75-100 employee, customer and
display spaces, which is key for a development of this type.
Option 4: Purchase additional properties — The tract is bordered by the Norfolk Southern
Railroad on the west and an existing automobile dealership to the north. Additional land (1.9
acres) south of the original tract, including the closing of Buoy Street right of way, has already
been purchased to provide the necessary vehicle display area. There are no additional tracts
available for purchase.
