Avoidance and Minimization 1a. Specifically describe measure taken to avoid or minimize the proposed impacts in designing the project. The existing businesses located at 1715 E US Highway 70 in New Bern, North Carolina are automotive dealerships for the manufacturers, Mazda and Kia. The Mazda (most northern) building was constructed in the 1970's and the Kia (center of tract) building in the late 1980's. Both buildings have received only minor improvements over the last thirty to forty years and are in need of major improvements to meet the current manufacturers modern sales requirements and is also a contractual obligation of the dealership owners. The Kia and Mazda of New Bern are approximately a thirty -mile radius from the same manufacturer located in other counties. This radius includes the counties of Craven, Carteret, Pamlico and Jones. Based on data from the U.S. Census Bureau, the population for this area has increased by 70% since 1970, also increasing the demand for automobiles. The existing Kia building is located near the center of the property and around twenty-five feet from the 404 -wetland line. It is approximately 2,025 square feet, including the showroom and sales offices. The Kia parts and service center is located at the rear of the Mazda showroom which is shared space between the manufacturers. The Mazda building provides a showroom, sales and the current shared parts and service center. Both manufacturers require modernization and expansion to both the showrooms and sales area. Kia is also requiring the addition of a parts and service center contiguous to its showroom and sales area to meet the current 2015 facility standards. The proposed building depth for Kia is 186' and is being expanded 46' on the roadside and 99.5' to the rear. The placement of the building provides the necessary employee, customer and service parking, including handicap accessible spaces, with a single row of exterior automobile display spaces along Highway 70. Kia's current building standards requires haulers and delivery trucks to have direct access to all sides of the building for sales and service operations. The typical maximum turning radii for a automobile hauler is 46'. The maneuvers expected for the various deliveries have been included in the attached drawing. Not providing truck access at the rear of the building disrupts the logical flow of traffic and could potentially reduce the number of display spaces needed for the expansion. The business model for the Mazda and Kia dealership expansion and modernization is to create an additional ten to fifteen employment opportunities. The projected sales volume indicates the need for approximately 280-300 parking display spaces for inventory. The approximate parking needed for employees and customers for sales and service is 65, totaling around 350 spaces expected for the current market. The site plan proposes an additional 60 spaces in the prospect for further growth within the area and an increase in demand. The proposed site design for the expansion of the buildings and parking requires submittal to NCDEQ-DEMLR for a coastal stormwater permit. The additional impervious on the site must be treated by a Stormwater Control Measure for the one -inch storm, since the site drains to Scotts Creek, Class C waters. A wet detention pond is proposed at the south west portion of the property. This State requirement will direct all runoff from the proposed impervious to the pond eliminating any runoff currently draining to the wetland area, potentially changing the hydrology of the wetland. 6. For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that would be affected in any way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an appealable action, by contacting the Corps district for further instruction. _ There are wetlands on the above described property, that may be subject to Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403).
