It is clear to DWR, that the areas where ponds are present within the 50' buffer do not meet the rules that were in place at the time the site was instituted. The rules stated as follows: 15A NCAC 0213 .0252 (9) (c)The riparian buffer restoration or enhancement site shall have a minimum width of 50 feet as measured... (d) Enhancement and restoration shall both have the objective of establishing a forested riparian buffer... The way we interpret this, is that the area being Restored or Enhanced must include a planted forested riparian buffer for the entire 50' as measured horizontally on a line perpendicular to the surface water. Therefore, DMS can only seek mitigation credit for areas along this stream where the entire 50' was planted. Please modify the asset table and map for this site to remove credits from TOB -50' where a pond is within the buffer. Once you resubmit the revised table and maps, I will review for final closeout acceptance.
