Subject: Meeting to Discuss PCN Submittal for City of Kinston Phase IV Briery Run Outfall
Sewer Rehabilitation
Mr. Jarrell,
Per our discussion, the Division of Water Resources received your Pre -Construction Notification on April 27, 2017 for
rehabilitation of the Briery Run sewer line Phase IV consisting of the installation 14,824 feet of access road, a cured in
place rehabilitation of 37 of 49 manholes and a cured in place rehabilitation of 4,290 feet of the 30 -inch sewer line. The
impacts associated with the proposed access road are as follows: 0.86 acres of wetland impacts, 19 perennial stream
crossings totaling 190 linear feet of impact and 3,800 square feet of Zone 1 and 5,700 square feet of Zone 2 impacts. As
part of the application review, this Office noted the following project details that would need to be addressed prior to a
complete review of the application can be completed:
• No Coordination with US Army Corps of Engineers - A complete review of the project cannot be conducted until
the U.S. Army Corps of Engineers has verified all stream and wetland locations for the proposed road. Per the
application, the proposed impacts were generated from the NC GIS Map.
• No Coordination with the Division of Water Resources - The DWR will need to perform stream determination
request for application of Neuse River Riparian Buffer Rules.
• Please provide details regarding avoidance and minimization of stream, wetlands and buffer impacts.
• Please enumerate all wetland and stream impacts including fill slopes/ dissipater pads/ other impacts on the site
plan and clearly label impacts (Wetland/ Stream Impact 1, etc.). The Division recommends highlighting by
hatching or shading all impacts areas for temporary impact areas and permanent impact areas.
• Please provide cross section details showing the provisions for aquatic life passage associated with your stream
crossi ngs.
• Per condition 11 3, compensatory mitigation may be required for losses of greater 150 linear feet of stream
and/or 1 acre of wetlands. Please provide this Office with a mitigation plan either to include payment to a local
mitigation bank or in -lieu fee program or on-site mitigation.
• Please provide plan details demonstrating that diffuse flow can be maintained through the entire Neuse River
Riparian Buffer.
This Office recommends a withdraw of the application until the items detailed above can be addressed. In addition, this
Office recommends a meeting with the DWR and US ACE to discuss the scope of the project.
