RE: Intermittent / Perennial (UP) Stream Determination Appeal for Stream Feature B,
John Gaster Heirs Property; Apex, Wake County, North Carolina
Mr. Eric Kulz conducted an onsite Intermittent/Perennial Stream evaluation in August of 2005 and
determined feature "B" to be perennial at a point immediately below a breached dam (see attached copy
of DWQ letter). However, after a recent evaluation we believe this feature is an intermittent stream and
lacks the necessary indicators of a perennial stream channel.
The site is within the jurisdiction of the Town of Apex, which requires I00-foot buffers on perennial
streams and 50-foot buffers on intermittent streams. The August 26, 2005 letter was not supplied to the
adjacent landowners surrounding the property at the time of the original field meeting. The 100-foot
buffer applied to perennial streams has rendered areas unusable that would not be so if a 50-foot buffer
were applied. Therefore, please accept this letter as an official request of a re-evaluation of feature "B" on
the subject property. S&EC does not dispute any other stream calls made on site.

manner. To ask for a hearing, send a written petition, which conforms to Chapter 150E of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 2 7699-6 71 4.
This determination is final and binding unless you ask for a hearing within 60 days.
