Based on the aerial photograph submitted with the original application and the aerial photograph submitted with the latest application, the project area appears to be located in an unmarked channel. Would this project area interfere with general navigation in the area? The application states that the nearest unmarked navigation channel is located 20 feet from the project area. Where is this channel located? 2. The project area appears to extend more than 1/3 the width of the waterbody. Please have the applicant reconfigure the project area in a manner that does not extend more than 1/3 the width of the waterbody OR provide reasoning for why this proposal will not interfere with navigation. 3. The SAV review area does not include the applicant's proposed project area. Has a SAV survey been completed for the project area? Does the project area contain SAV? Also, the project area is located within the boundaries of a known historic district that is listed in the National Register of Historic Places. Our office will need to coordinate and/or consult with the State Historic Preservation Office before we can authorize this NWP. For future submittals, please show coordinates in decimal degree units. The above requested information must be provided in order for our office to complete the evaluation for this NWP. Enclosed is the application, shellfish lease investigation report and a map of the proposed lease location. In order to more fully evaluate other factors which may affect the possible issuance of this lease, it is requested that Marine Patrol, Fisheries Management and Shellfish Sanitation complete the attached review form. As previously agreed to earlier this year, this application and site information also serves as the joint application to the US Army Corp of Engineers Nationwide Permit 48. Division sections, please return forms and comments via email to Marla.Chuffo@ncdenr.gov by May 19th. Non -DMF comments or questions should also be directed to Marla. North Carolina General Statute 113-202 requires comments to be evaluated by the DMF director and if approved to post two legal notices and hold a public hearing during at the end of a 30 day public comment period.
