Hi,
I had a meeting with James Taylor concerning the avoidance and minimization issue
with this project. The circle was round.
I did find several two story commercial buildings in the area (actually less than .1
mi from site), but that is not what the developer wants. The issue with the two
story is that they will have to dig out more poor soil and fill with good material
(which was not indicated in the economic analysis) and therefore if the project
costs go up then they may still want another building to improve the economic value
to the property (so says James). The developer is out of Charlotte and his Realtor
is here in Wilmington, who is helping him plan this project.
Do I need to get him to get me the cost of the removing of the soil, the fill
etc.... to justify the two story verses two one story buildings and economic
difference in profit? What is the cutoff o number for profit?
I told James that they would also have to have some semblance of a stormwater plan,
prior to my issuing of the 401. He stated that they could not get a stormwater plan
until the wetlands had been approved for fill. So we need to come to some type of
decision of the two buildings vs two story .... so now you see the circle I am in.
I went out with Vince and the wetlands are still really wet (but the trees have been
cut). I also have concerns about the flooding out of the neighbor behind the
project, but James said that he had dug a ditch on the property line that flows
under the road into a ditch flowing westward. James said when he, Tom Farrell and
Brad Shaver went out there there was no water and it was bone dry.
The project is within a half mile of SA waters and the stormwater requirement (the
old ones at least dictated that no ponds could be used) and the new ones who knows.
I really need help with this one, if you ask me if this is worth the battle, my
answer would be ...only time will tell (I don't know).
My other question is ....since the isolated wetland permits will expire on September
30th (and really do not apply to this type wetland). Do I go ahead and issue the
permit or wait?
