I spoke with Mr. Taylor on 8/18 about this situation to listen to his concerns. After consulting with
staff, I indicated to him through a voicemail message on 8/21 that he would be receiving a letter
requesting more information regarding the quantification of impact on the site and backup
documentation to justify the size of the needed stormwater pond.

issue as well as another one. The problem is that the site is 100% wetlands and a small portion
across the front has historical fill. The project design does not make any attempt to avoid or

Hello:
I have a client (the project discussed by Craig Bromby where the
wetland
is a no-significant nexus wetland that we are using the isolated
permit
to fill along Hwy 17 in Hampstead, New Hanover County) who will be
facing another issue with their project.
I met with DWQ 401 and stormwater staff in Wilmington re: this
project.
401 states "policy" and the new PCN (that will take affect in
September)
requires them to have an issued stormwater plan prior to issuing a
401
certification/permit.
The stormwater staff stated he could not issue a stormwater permit
where
stormwater structures were located within a wetland since he would
need
a 401 cert/permit prior to issuing the stormwater permit in those
(perhaps limited) instances.
I see a catch 22 where my client will be (once we resolve any
remaining
issues) will still be in a waiting pattern, unable to get either
permit.
Since 401 and stormwater both do not like receiving different plans
for
their permit applications for the same project, is it possible to have
a
joint application? Say Part A for Stormwater and Part B for 401?
This
way each consultant could still retain their work, 401 and Stormwater
would have the same plan to work from re: their permit application,
and
everyone would avoid the Catch 22 situation...
I am hoping we can all get together to avoid a potential problem that
would be time consuming and may The a bad situation for DENR, the
public, and for those who consult in those fields.
I have contacted Ed Beck in Wilmington and left messages in Raleigh
DWQ.
Since 401 and Stormwater consult on each other's permits anyway, I
thought a joint (Part A & Part B) application might be appropriate,
and
each Part could be independent of the other--you could allow
stormwater
section (Part A) to be completed separately when a stormwater plan
does
not require a wetland permit (leaving Part B with a checkbox stating
"No
wetland permit required").
