Division of Water Quality (DWQ) letter dated June 16, 2008. This additional information is an amendment to our existing Individual Permit application under review by both the USACE (Action ID No. 200801712) and DWQ (Project No. 06-1804, Ver. 3) for the proposed The Village at Flowers Plantation project. The comment period for this Public Notice expired on June 30, 2008. The only comments that were received by the USACE were submitted by a North Carolina citizen and president of the North Carolina Environmental Restoration Association, Mr. John Preyer and a Request for More Information letter from the DWQ dated June 16, 2008. However S&EC received a letter from the N. C. Department of Cultural Resources-State Historic Preservation Office (SHPO) dated May 30, 2008 in response to a letter we sent them on April 1, 2008 (see attached). No other written comments were received as of the expiration of the comment period. An office meeting was held at River Dell Company, Inc. office on July 16, 2008 to discuss comments received during the public comment period including the DWQ letter requesting additional information dated June 16, 2008 (see attached) and any additional comments and concerns of the USACE and DWQ. Those in attendance included; Bob Zarzecki (S&EC,PA), Kevin Martin (S&EC, PA), Debbie Edwards (S&EC, PA), Rebecca Flowers (River Dell Company, Inc.), Charles Royal (River Dell Company, Inc.), Paul Smith (Stocks Engineering, PA),'Thomas Brown (USACE), Lauren Witherspoon (DWQ), Ian McMillan (DWQ), Annette Lucas (DWQ) and Amy Chapman (DWQ). ADDITIONAL INFORMATION USACE Public Notice Comments: The only comment, other than the DWQ letter, received by the USACE during the public notice period was a letter from a Mr. John Preyer, president of the North Carolina Environmental Restoration Association. This letter basically states that the use of the proposed in-lieu fee payment to the NC Ecosystem Enhancement Program (NCEEP) is inappropriate compensatory mitigation for the project for two primary reasons; a) The proposed mitigation contradicts the Corps' current policy (i.e. compensatory mitigation should be located within the same 8-digit hydrologic unit as the impacts), and b) The proposed mitigation contradicts the Corps' current policy because there are stream mitigation credits available in a mitigation bank that have been approved and released by the Corps within this same 8 digit HUC where the stream impacts are located. In our meeting on July 16, 2008, mitigation was discussed further. Along with compensatory mitigation, the USACE would also like to see preservation. The USACE indicated to target the streams that were identified as having a 2:1 mitigation Page 2 of 9 The Village at Flowers Plantation - Individual Permit September 12, 2008 Additional Information S&EC, PA 6658 ratio and to keep all lot lines out of the 50 ft. riparian buffer. Buffalo Creek and its floodplain were also discussed as an area to include in the preservation area. With regards to the compensatory mitigation, at this time S&EC is in correspondence with the Forrest Creek Mitigation Bank to determine if there are mitigation credits available for this project. This information, along with further discussions with the USACE will determine if the compensatory mitigation will be handled through the NCEEP or an appropriate Mitigation Bank. The applicant anticipates submitting a conservation area map and draft restrictive covenant for the preservation of streams on the property. DWQ June 16, 2008 Letter (see attached): 1. Please provide intermittent/perennial stream determination documentation on the site (upstream and downstream photos and DWQ stream identification forms). DWQ requested intermittent/perennial stream determination documentation for the site within their "Request for More Information" letter. During the July 16th meeting, Lauren Witherspoon and Thomas Brown were both present and verified that they have both been to all impact areas on the site and have made intermittent/perennial and unimportant/important stream determinations. Additionally, the original application submitted to the USACE on May 1, 2008 included the Intermittent/Perennial Stream Determination letter (IPRRO 08-013). Therefore it was determined that no additional information was needed. 2. Buffer mitigation is required for all road crossings that impact 150 linear feet of riparian buffer or more. Please submit a mitigation plan detailing the amount of buffer impact at crossings 1 & 3 and how the impact will be mitigated. Since the receipt of the June 16th DWQ letter, the project engineer has reviewed all proposed road crossings that could potentially exceed 150 linear feet of riparian buffer impact, specifically road crossings 1, 3, 5, 7 & 11. As a result of this review, the project engineer was able reduce the fill slopes from 3:1 to 2:1 and add retaining walls where needed to get the riparian buffer impacts below 150 linear feet on road crossings 5, 7 & 11, in addition to road crossings 1 & 3 to avoid riparian buffer mitigation. As such, these modifications have resulted in revised impacts to streams and riparian buffers. Please see revised impact tables and attached revised impact exhibits. Note that these tables only include impact areas that have changed since the initial application and not a comprehensive list of all stream, wetland and riparian buffer impacts. This proposed reduction is a result of the mitigation discussion within our July 16th meeting proposing preservation to offset the adjacent watershed 3:1 mitigation ratio that would have been required by the agencies. 3. Please provide documentation from the NCEEP indicating their willingness to accept your request to purchase buffer mitigation credit to mitigate for the proposed crossings 1 & 3 buffer impacts listed in your PCN application per section Vlll, No. 2. Since the project engineer was able to reduce the fill slopes from 3:1 to 2:1 on road crossing 1 & 3 which resulted in riparian buffer impact below 150 linear feet, riparian buffer mitigation should not be required. Additionally, as stated above, road crossings 3, 5, 7 & 11 were also reviewed and all reduced below 150 linear feet of riparian buffer impacts. 4. Please provide a more specific, detailed mechanism to assure DWQ that: a. All lots are buildable without additional wetland, stream or buffer impact, and In our July 16th meeting, deed notifications were discussed as a mechanism to ensure avoidance of impacts to wetlands, streams or buffers in the future and the applicant understands these may be required as a condition of the permit and/or certification. Additionally, preservation in the form of restrictive covenants was discussed to meet the mitigation requirements on this project. The applicant anticipates submitting a conservation area map and draft restrictive covenant for the preservation of streams on the property. b. That stormwater from the entire site will be treated since the site is in the Neuse basin either through level spreaders for sites with low impervious coverage or other means for higher impervious coverage. This project is only requesting impacts needed for the road infrastructure within the overall project; at this time detailed design associated with residential or commercial development has not been finalized. Therefore detailed design associated with diffuse flow and/or stormwater is not available. Furthermore, in Page 6 of 9 The Village at Flowers Plantation - Individual Permit September 12, 2008 Additional Information S&EC, PA 6658 our original application submittal, conceptual level spreader designs were provided for each road crossing. However, discussions in our July 16th meeting resulted in the removal of these conceptual level spreaders from the impact exhibits to eliminate any future compliance questions and an agreement by the DWQ to incorporate a condition within the Individual Certification that would require a detailed stormwater management plan and/or diffuse flow plan to be submitted to the DWQ for review and approval on a phase by phase basis. 5. Please re-submit your site plans on full plan sheets at a scale of no smaller than I" = 50'. Since it was agreed upon in the July 16th meeting, to allow the submittal of the detailed stormwater management plans and/or diffuse flow plans for review and approval by the DWQ on a phase by phase basis, it was determined that full plan sheets at a 1" = 50' scale were not necessary at this time. However, a full size plan sheet at a scale of 1" = 100' should be submitted along with any future stormwater management plans and/or diffuse flow plans to the DWQ. 6. Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage from this site must meet the state's diffuse flow requirements as set forth in Chapter 8 of the North Carolina Stormwater BMP Manual, available at: http://h2o.enr.state.nc.us/su/bmp forms.htm. Please provide one Level Spreader Supplemental From for each proposed level spreader, available at: http://h2o.enr.state.nc.us/su/bmp forms.htm. Please include the Required Items checklist and all items listed therein. If the filter strip is too steep for a level spreader in any location, then you must provide a BMP that removes a minimum of 85 percent TSS and 30 percent TN from the stormwater generated by this project. For each proposed BMP, please provide a completed BMP Supplement Form wit all required items. The BMP Supplement Forms are also available at the above web site. As stated above in the response to 4.b, the DWQ agreed to incorporate a condition within the Individual Certification that would require a detailed stormwater management plan and/or diffuse flow plan to be submitted to the DWQ for review and approval on a phase by phase basis. 7. Please provide a conceptual stormwater management plan for the project that includes the following: a. A depiction of the drainage areas on site. b. An estimation of the percentage imperviousness associated with each of the drainage areas. c. A calculation of the water quality volume associated with each drainage area. d. A depiction of a proposed BMP (state the type of BMP you plan to use) on the site plan that is correctly sized based on the water quality volume. Page 7of9 The Village at Flowers Plantation - Individual Permit Additional Information September 12, 2008 S&EC, PA 6658 As stated above in the response to 4.b, the DWQ agreed to incorporate a condition within the Individual Certification that would require a detailed stormwater management plan and/or diffuse flow plan to be submitted to the DWQ for review and approval on a phase by phase basis. SHPO May 30, 2008 Letter (see attached): On April 1, 2008, S&EC sent a letter to SHPO requesting comments or concerns regarding potential development activities performed at the Village at Flowers Plantation site. On May 30, 2008, S&EC received a response from SHPO requesting photographs of any structures more than fifty years old or older on or adjacent to the project site, in addition to a recommendation that a comprehensive survey be conducted by an experienced archaeologist to identify and evaluate the significance of archaeological remains that may be damaged or destroyed by the proposed project. During our meeting on July 16, 2008, this letter was discussed with the USACE. Ms. Flowers identified one house older than 50 years and one new house replicating a pre-existing house. Ms. Flowers agreed to send photographs to SHPO for their files, however does not feel that a comprehensive survey is warranted. Mr. Brown agreed and said that the USACE never received a request during the public comment period. Our understanding is that Mr. Brown does not believe that the proposed project will have the potential to cause effects on any historic properties. CONCLUSION It is our understanding that this additional information will provide you all of the information required for you to continue the review of this individual permit application, with the exception being the conservation area map and draft restrictive covenant language for preservation. Our files indicate that our survey is more than 20 years old. Therefore, if there are any structures more than fifty years old or older on or adjacent to the project site, please send us photographs (digital snapshots are fine) of each structure. These photographs should be keyed to a map that clearly shows the site location. If there are no buildings over fifty years or older on or adjacent to the project site, please notify us of this in writing. According to our files, archaeological sites 31JT350 through 31JT357 are located on either side of SR 1003 just north of Flowers. Recorded in 2002, apparently for a project not subject to Section 106 review, these sites' forms were never submitted to us. Thus, we consider them unassessed as to their eligibility for the National Register of Historic Places. The current tract overlaps that reviewed by us for ER 01-7183, road access for a project submitted to us by the Edenton Group. Though we recommended this tract, no survey has been conducted. We consider the Flowers Plantation East Section tract to be of comparable probability for the location of significant archaeological sites. We recommend that a comprehensive survey be conducted by an experienced archaeologist to identify and evaluate the significance of archaeological remains that may be damaged or destroyed by the proposed project. Potential effects on unknown resources must be assessed prior to the initiation of construction activities. In addition, we recommend that sites 31JT350 through 31JT357 be relocated and assessed for their eligibility. Two copies of the resulting archaeological survey report, as well as one copy of the appropriate site forms, should be forwarded to us for review and comment as soon as they are available and well in advance of any construction activities. A list of archaeological consultants who have conducted or expressed an interest in contract work in North Carolina is available at www.arch.dcr.state.nc.us/consults. The archaeologists listed, or any other experienced archaeologist, may be contacted to conduct the recommended survey. The River Dell Company, inc. is proposing to permanently impact 1,439 linear feet of streams and temporarily impact 220 linear feet of streams for the construction of infrastructure at its Village at Flowers Plantation development east of Clayton in Johnston County. North Carolina. The project is located in the Neuse River Basin 8-digit HUC 03020201. According to the public notice, the applicant proposes to mitigate at a 2:1 ratio for .impacts to 684 linear feet of stream and at a 1:1 ratio for impacts to 339 linear feet of stream through payment to the Ecosystem Enhancement Program (EEP) for 1,707 linear feet of warm water stream restoration 1a Neuse River. Basin 03020202. The use of the proposed in-Lieu fee payment to the EEP is inappropriate compensatory mitigation for the proposed project for two primary reasons: (1) The proposed mitigation contradicts the Corps' policy that compensatory mitigation be located within the same 8-digit hydrologic unit as the impact except on a case-by-case basis. (2) The Corps has approved and released stream mitigation credits available at Mid- Atlantic Mitigation's Forrest Creek Mitigation Bank iu the Neuse 01 HUC. One of which is that no approved mitigation banks are available. No such emergency exists in this case - credits from a private mitigation bank are available for purchase. There appears to be no valid rationale for the proposed mitigation (coming from EEP) to be located in a separate 8-digit HUC other than the USACE arbitrarily mandating it. At a minimum, them- should be a substantial penalty ratio attached to the mitigation amount required for any applicant going outside of the 8 digit HUC. The NCEM urges the Corps to carefully. reconsider the ap ypnateness of the nroyosed c_orrnpensatM mitigation_foLft impact It is unclear from the public notice why the Corps would arbitrarily act against its own regulatory guidance. Further, the proposed mitigation would appear to contradict the federal rule for compensatory mitigation, which went into efr'eet less than 10 days after the publication of this public notice. The subject application appears to be only for the infrastructure and not for the full development. In addition to the consideration of these comments, I request that the USACE provide me the estimated amount of impacts foT the future development if any.
