Dear Mr. Oakley:
Attached herein are invoices received from the Cherokee Scout, Asheville Citizen Times,
Franklin Press and The Smoky Mountain Times requesting payment in the total amount of
$367.00 for legal advertising. The newspaper published Public Notices for an application for a
401 Certification for the proposed FERC relicensing on August 6, 8, 13 and 14, 2008.
Please note that in accordance with 15A NCAC 2H .1 303(l), an applicant for an Individual
Certification shall pay to the department the costs of advertising public notices required by 15A
NCAC 2H .1303 of the Isolated Wetland Rules. Please remit payment in the total amount of
$1,125.84 to each of these papers at your earliest convenience and provide a copy of your letter
and a copy of the checks to the DWQ.

PUBLIC NOTICE is hereby given that Duke En-
ergy Carolinas, LLC North Carolina, has applied
to the North Carolina Division of Water Quality
Certification pursuant to Section 401 of the Feder
al Clean Water, Act and Wbter Quality Commis
sion rules in 15A NC AC 2H 1300. The activity fat
this Certification is sought to relicense the
Franklin, Bryson and Mission hydroelectric
plants on the-Little. Tennessee, Oconaluftee, an
Hiawassee Rivers respectively in Macon, Swai
and Clay/Cherokee Counties respectively. Th
application refers to water quality-related Provi
sion of the Tuckaseegee Settlement Agreemen
dated December 2003 as. Proposed conditions o
the 401' Water Quality Certification. The applica-
tion discusses water quality-related im-
provements that are planned to the hydroelectric
facilities including minimum flow release, water
quality monitoring and compensatory flow miti-
gation.
The bublic is invited to comment on the above
mentioned application to the Division of Water
Quality. Comments shall be in writing and shat
be received by the Division no later than Septem
ber 8, 2008. Comments should be sent to the N.C
