(SEI) on behalf of Cimland, LLC, is submitting 5 copies of the following requested information and response to comments from your letter dated July 23, 2008 for the above referenced project, located along Chandler Road, north of NC 98 in Durham, North Carolina. 1. Please re-submit your site plans on full plan sheets at a scale of no smaller than 1" = 50' with topographic contours. • Please find 5 copies of the attached full size plans which have been approved by Durham County. These plans were approved at a scale of 1 " = 60' and according to a conversation with Ian McMillian of DWQ on August 21, 2008 the scale of these plans will be considered sufficient. 2. Per the requirements of the Neuse River Riparian Buffer Rule, you must show that the site meets diffuse flow requirements with a level spreader or other BMP per Chapter 8 of the BMP Manual (see http://h2o/enr/state/nc/us/su/bmn forms.htm). • Please refer to Sheet C410 of the attached plans for Storm Outlet Details. These plans have been approved by Durham County and depict the use of 2 level spreaders to meet diffuse flow requirements. 3. Please provide an inventory of imperviousness surfaces in each drainage area. The inventory should include all purposed building footprints, roads, driveways, sidewalks, gravel-surfaces, amenity areas, etc. A Stormwater Management Plan (SMP) must be provided for any drainage areas that exceed 24 percent imperviousness. Per NCAC 213 15A: 02H.10000, a "drainage area" is defined as "the entire area contributing surface runoff to a single point." • Please refer to Sheet C.100 of the attached plans for Impervious Surface Area Calculations. The total impervious area exceeds 24 percent and therefore we are including the approved SMP and Approval letter from the City of Durham. 4. 360 square feet of compensatory buffer mitigation is required for this project. Please provide a compensatory mitigation plan. The plan must conform to the requirements of 15A NCAC 2H .0500 and must be appropriate to the type of impacts proposed. • Please find attached a copy of the acceptance letter for payment into the North Carolina Ecosystem Enhancement Program (NCEEP) for mitigation to 360 square feet of Neuse Buffer Impacts. The applicant proposes to pay the in-lieu fee for compensatory mitigation to the buffer impacts. If you have any questions, or require additional information, please contact me at 919-875-4288. It is your responsibility to provide the following before the City can accept any public streets or utilities for permanent maintenance. (l) Certified as-bull" (mylar) drawings, including all water and sewer services referenced to property lines; (2) All easements, rights-of-way, and subdivision maps must be recorded; (3) Provide a 12-month warranty for all public improvements; (4) Certification for water and sewer construction.. A certification is required from a N.C. Professional Engineer that water and sewer lines have been installed according to the approved plans and specifications. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following table. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Environment and Natural Resources and the U. S.
