Ives 1701 Sunset Ave. Rocky Mount, NC 27804 Subject Property: Bridgecreek Point Subdivision Smith Creek, 030407, 29-34-35-5, NSW, SC REQUEST FOR MORE INFORMATION Dear Mr. Ives: On May 30, 2008, the Division of Water Quality (DWQ) received your application dated April 28, 2008, to impact 0.047 acres of waters and 0.037 acres of coastal wetlands to construct a navigational channel to a permitted 51-slip marina. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and 2B .0259(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Avoidance and Minimization The DWQ received your response to a "Request for More Information" letter issued on July 10, 2008. Within that request was item number 2 "Avoidance and Minimization". The DWQ does not feel that you have adequitly responded to this item. Specifically we would like you to demonstrate the purpose and need for an access channel that has a bottom width of twenty-four (24) feet. As discussed in the prior "Request for Information" letter your original permit that was issued in March of 2007 stated that no dredging would be required to facilitate the function of this marina. Please demonstrate why a narrower access channel could not be utilized to achieve the activities of this marina. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
