Subject: REQUEST FOR ADDITIONAL INFORMATION

To Whom It May Concern:
On March 27, 2017, the Division of Water Resources (Division) received your application dated
March 23, 2017, requesting a 401 Water Quality Certification / Buffer Authorization from the
Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on -hold until all of the following information is
received:
1. Page 10 of 10 carries the signature of Jim Spangler. In order for Jim Spangler to sign, the
application package requires an agent authorization letter from the Wakefield
Development Company in addition to the agent authorization provided for the property
owner. [15A NCAC 02H .0502(f)]
2. A complete review of the project cannot be conducted until the U.S. Army Corps of
Engineers has verified all stream and wetland locations for the project. [15A NCAC 02H
.0502(a)(7)]
3. Please provide the most recent version of the 1:24,000 USGS Topographic Map. Please
cleanly draw or delineate the site boundaries on the topographic map. [15A NCAC 02H
.0502(b)]
4. Please provide a most recent bound and published county soil survey. Please cleanly
draw or delineate the site boundaries on the soil survey. [15A NCAC 02H .0502(b)]
5. Please re -submit your site plans on full plan sheets at a scale of no smaller than 1"=50'
with topographic contours shown. In addition, please upload an electronic copy using the

6. Please enumerate all wetland and stream impacts including fill slopes/ greenways / utility
lines on the site plan and clearly label impacts (Wetland/ Stream Impact 1, etc.). The

Division recommends highlighting by hatching or shading all impacts areas for temporary
impact areas and permanent impact areas. [15A NCAC 02H .0502(g)]
7. This project is located within the planning jurisdiction of the Town of Morrisville
(Morrisville). Morrisville has been delegated implementation of the Neuse Riparian
Buffer Rule in their jurisdiction. You will need to apply to Morrisville for a Buffer
Authorization to cover buffer impacts and approval of a stormwater management plan
the project. [15A NCAC 02B .0267(3)]
8. Complete Section D.1. of the PCN application to specifically describe measures taken to
avoid or minimize the proposed impacts in designing the project. [15A NCAC 02H
.0506(c)(2)]
9. Explain whether surface water or wetland impacts will be required to connect the project
to the Morrisville greenway system. [15A NCAC 02H .0506(4)]
Pursuant to Title 15A NCAC 02H .0502(e) / 15A NCAC 02B [Neuse] .0233, the applicant shall
furnish all of the above requested information for the proper consideration of the application. If
all of the requested information is not received in writing within 30 calendar days of receipt of
this letter, the Division will be unable to approve the application and it will be returned. The
return of this project will necessitate reapplication to the Division for approval, including a
complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending three copies
of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail
Service Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Section 401 of the Clean Water
Act/Buffer Rules for this activity and any work done within waters of the state may be a violation
of North Carolina General Statutes and Administrative Code.
