Hanes Mill Road, Suite 300 Winston Salem, North Carolina 27105 RE: DWR Request for Additional Information Clearwater Paper Corporation Cleveland County, North Carolina Action ID SAW -2014-00061; DWQ Project # 2010-0899 v3 Dear Ms. Homewood, Please reference the letter dated March 9, 2017 (Attachment A) sent by the NC Division of Water Resources (DWR) in response to the permit application submitted by C1earWater Environmental Consultants, Inc. (CEC), on behalf of the Clearwater Paper Corporation represented by Mr. Brian Hoaglund. The permit application requested written authorization for the impacts associated with expansion of the existing Clearwater Paper facility and associated infrastructure. The comments provided by the DWR are discussed below. Based on further refinements to the site plan (Attachment B - Figure 6) proposed stream impacts amounts have changed at impact locations 1, 2, and 3. The proposed permanent stream impact grand total submitted in February 2017 was 1,682 If of stream impact and 0.12 acres of wetland impact. The new proposed impacts based on the refined site plan is 1,599 If. There are no changes to the proposed wetland impacts. DWR Comment #1— If the US Army corps of Engineers requests a response to any comments received as a result of the public notice, please provide the Division with a copy of your response to the USA CE. The applicant will send a copy of response to Corps comments as requested. DWR Comment #2 - "based on the information provided in the application and associated documents, all surface flow from the drainage area to Impact #2 will be replaced with impervious are that is proposed to be rerouted through a stormwater control measure. The rerouting of the drainage areas and surface flows has the potential to remove hydrology and therefore the existing uses with in the stream channels from the impacts to the proposed stormwater outlet location/confluence with another stream channel. Please provide a thorough analysis and any additional information relative to this issue for further review by the division. The applicant has provided an updated site plan, Figure 6 that shows the new configurations for the 3 stormwater ponds. Full details for the Stormwater Management Plan are provided in the Stormwater Management Plan (SMP) for 2S and 3S prepared by Amec Foster Wheeler (AFW) and submitted directly to DWR by AFW for review and approval on May 5, 2017. The attached Figure 6 shows the outlet for Wet Pond 1 has been relocated and discharges near the top of the unimpacted stream. There will be approximately 90 ft. of stream remaining below impact #2 before the stormwater discharges into the stream. This short area of stream should maintain some water flow provided by the French drain and the small watershed around this area. Wet pond 2 now discharges at the top of the unimpacted stream. Thereby maintaining hydrology in the stream channel below. Stormwater Pond 3 does not impact a stream or wetland. This pond outlets stormwater towards the southeast and into an existing wetland. DWR Comment #3 - "Please provide more details regarding avoidance and minimization of the impacts for this project. This office believes that the area within the northeast corner of the development labeled on the plans as parking can be moved or reconfigured utilizing adjacent upland on adjacent property to the southwest that was evaluated at early stages within this proposal in order to avoid or minimize impacts #3 and impacts #4. Please revise the plans to avoid the impacts or provide a detailed explanation of why this plan for the activity cannot be practically accomplished, reduced, or reconfigured. The updated site plan has reduced overall prosed stream impacts for the site. The office, main entrance, and employee parking areas are all located in the northeastern section of the mill and are aligned with the converting operation where roughly 2/3 of the mills employees work. The access road and parking for 300 employees is located in this area. In addition, there must be sufficient area in the northeast corner for loading and unloading trucks, truck parking, and turning radius for large trucks. This mill configuration is consistent with the design of the current operation across the street. Figure SKT-0010 (SMP submitted by AWF) provides cross section details of the building site in the northeast corner. Due to the presence of the stream at proposed impact 3 the applicant is constructing an approximately 22 -foot -high retaining wall to minimize slope fill, stream impact, and still provide employee parking area and truck access for the mill. The access Ms. Sue Homewood 05.4.17 Page 3 of 7 road in the northeast comer begins almost 30 feet below the finished elevation of the mill and employee parking areas. The property will be developed in phases from north to south, so the "southwest comer" will move to the southern boundary of the facility as the operation expands. It should be noted that the initial plan for the site included 3 paper machines with associated converting and warehouse operations. This plan was scaled back to 2 machines and the entire facility was moved as far south as practical on the property to minimize stream and wetland impacts. In the early stages (July 2011) of acquiring property for this project Cleveland County engaged a real estate broker to assist with negotiations in an effort to acquire and assemble property for future industrial development. Over the next six months the County was able to acquire approximately 348 acres which included the following parcels (40797, 32624, 32196, and 61941). During this same period, the broker of record met with the owners of Parcel 73679 (35.68 acres), Parcel 28687 (33.469 acres) and Parcel 51545 (30.145 acres) on multiple occasions in an effort to negotiate the acquisition of said property on behalf of Cleveland County. All three of these parcels are located adjacent to and on the south side of the project. Negotiations were unsuccessful as owners of the parcels identified were not interested in selling the property. As a result, Cleveland County suspended fiuther negotiations and efforts to acquire additional adjacent property for future industrial development. Ownership of the property has remained unchanged except for the acquisition of right-of-way purchased by the NC Department of Transportation necessary for the construction of the Hwy 74 Bypass. Given the land development constraints of gradings, roads, railroad elevations and access, it is not possible to move the project any further to the south and avoid additional streams. The pre -application showed a conceptual fixture road connection from the project site to the new US Highway 74 By-pass. However, this conceptual plan is not possible because property to the south is not owned by CWP, Cleveland County or DOT. DWR Comment #4 - Please clarify whether the Division of Energy, Mineral and Land Resources will require riprap within any stream channels or wetlands as part of the Erosion & Sedimentation Control Plan approval. If riprap is required, please enumerate and clearly label the temporary and permanent impacts on the site plan and submit a channel restoration detail. Riprap must be located below the stream bed elevation. The applicant has completed a more detailed site plan (Figure 6) and this includes additional impacts associated with the placement of rip -rap. Impact I - TGS Engineers have completed the entrance road design from Farmville Road into the site. This road crosses the unnamed tributary to Brushy Creek. The permit application originally proposed 200 linear feet of impact. Ms. Sue Homewood 05.4.17 Page 4 of 7 However, after final design by TGS, stream impacts associated with this crossing will be 250 ft. for the culvert impact and 20 feet of imbedded rip -rap (Attachment C - Road Crossing Details: Sheets 1-5). The culvert will be installed in accordance with DWR, Water Quality Certification 3890 (Condition 13) and any conditions imposed by the US Army Corps of Engineers (Corps). These conditions include requirements to cross streams at perpendicular angles; and provisions for maintenance of stream dimensions and aquatic life passage. Impact 2 — AFW engineers have refined the site plan (Figure 6) and Impact 2 has been reduced from 910 linear feet to 7371f. of fill impacts and 73 If. of imbedded rip -rap for stream protection. Outlet protection detail are provided in the SMP submitted by AFW (Figure SKT-0006). Impact 3 — AFW engineers have refined the site plan (Figure 6) and Impact 3 has increased from 468 linear feet to 473 if of fill and 25 if of imbedded rip -rap for stream protection Outlet protection detail are provided in the SMP submitted by AFW (Figure SKT -0005). DWR Comment #5 - For the impacts within the utility corridors, some of the proposed stream crossings are not aligned as perpendicular crossings. Please re -configure your proposed stream crossings to show it aligned approximately perpendicular (between 75° and 105°) to the stream or provide justification for any non perpendicular crossings. The gravity sewer line design plans have been completed by McGill Associates and are included in Attachment D. Updated Figure 8 is also included in Attachment D. Please note that during final design temporary impacts to streams have been reduced from 2141f. of temporary impact to 801f. Stream impacts were reduced at four location by shifting the alignment to avoid streams and by designing 4 aerial crossings. Temporary impacts to wetlands have stayed the same. Two existing 20 ft. culverts within the easement will be replaced following NWP 3 maintenance guidelines (Sheets C-102 and C-111). Wetland areas with temporary impacts will be regraded to the original contour and covered with a wetland seed mix (Sheet (C- 504). The stream bed and banks will be restored (Sheet C-505) following temporary impacts. The proposed gravity sewer line alignment was selected to be parallel to the City's existing gravity sewer line so that the new sewer line can generally remain within the existing utility easement and limit ground disturbance to within the existing City right-of-way (ROW). This alignment also allows for the most efficient sewer flow by minimizing turns in the sewer line that require additional manholes. This parallel alignment also minimizes the width of the utility easement. In the three location that the crossings are not within DWR's definition of "approximately perpendicular," the crossings are in small streams and the temporary impacts to the streams and bank stabilization should not be significant. Ms. Sue Homewood 05.4.17 Page 5 of 7 To change the alignment for these three crossing would require purchase/condemnation of additional ROW and the addition of two new manholes for each crossing. DWR Comment #6 - Please provide a detailed engineering plan, profile view, and cross- section of all proposed culverts. These drawings must include details regarding stream alignment in relation to pipe alignment, pipe slope, pipe burial, and dissipater pad. Culvert crossing details for the northern entrance road proposed stream impact 1 are discussed above (comment #4) and included in Attachment C - Road Crossing Details: Sheets 1-5. French drain fill details for proposed stream impacts 2 and 3 are shown on updated figures submitted with the SMP submitted under separate submittal by AFW. Specifically Figures, SKT-0005, SKT-0006 and SKT-0007. DWR Comment #7 - All work must be done "in the dry" to protect downstream water quality, therefore dewatering methods will be necessary to temporarily dewater the stream channel during pipe installation. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. In addition, please ensure that the location of the temporary impacts are shown on the construction drawings and clearly indicated in a revised impact table. The entrance road design has been prepared by TGS Engineers. The culvert installation details including working in the dry (temporary dewatering) are included Attachment C - Road Crossing Details: Sheets 1-5. The site plan has been updated by AFW (Figure 6). The French drain details including working in the dry (temporary dewatering) are shown on updated figure SKT-0005 submitted with the SMP submitted under separate submittal by AFW. The complete gravity sewer line detail sheets prepared by McGill Associates for the gravity sewer are included for your review (Attachment D). Please note that an updated impact table for temporary impacts associated with the gravity sewer line installation is included on the cover page, Sheet G-002, as well as details for work in the dry (sheet C-505). DWR Comment #8 - Please provide a complete Stormwater Management Plan for this project. A complete SMP shall include: a. Stormwater management shall be provided throughout the entire project area in accordance with 15A NCAC 02H.1003. For the purposes of 15A NCAC 02H .1003(2)(a), density thresholds shall be determined in accordance with 15A NCAC 02H.1017 Ms. Sue Homewood 05.4.17 Page 6 of 7 b. A full-sized plan sheet showing the entire site with its storm drainage system, including every inlet, outlet and conveyance device. Please show how stormwater management requirements have been met at every proposed outlet location. [15A NCAC 02H.0506(b)(5) and (c)(5)J c. All appropriate stormwater control measure (SCM) supplemental forms and associated items, that complies with the high-density development requirements of 15A NCAC 02H.1003. The stormwater treatment plan was prepared by AMEC Foster Wheeler and was submitted under a separate cover to Ms. Sue Homewood for review and approval on May 5, 2017. The applicant also received comments from the US Army Corps of Engineers (Corps). The applicant will be submitting response to those comments by May 31, 2017. Because overall stream impacts have changed and to address mitigation updates, we have included the Corps comment and additional information below. We (Corp) have determined that, if the permit is issued and credits are purchased from the North Carolina Division of Mitigation Services, compensatory mitigation at a ratio of 0.5:1 would be required for the low quality intermittent stream impacts, a ratio of 2:1 for high quality perennial stream, a ratio of 1.75:1 for medium quality perennial stream, and a ratio of 0.75:1 for medium quality intermittent stream. Please revise the mitigation plan accordingly and submit a final mitigation proposal. Below is an updated table indicating the required mitigation. An updated letter from the NC DMS has been requested and will be forwarded to you as soon as it arrives.
