Subject: APPROVAL OF STORMWATER MANAGEMENT PLAN
Pad NE -2 and NE -5 at Flowers Plantation
Dear Mr. Mangum:
The Division of Water Resources (Division) recently reviewed the proposed stormwater management plan
(SMP) for the subject project as required by Individual 401 Water Quality Certification #3766 issued by the
Division on March 15, 2010. Submittal of the SMP satisfies Condition No. 9 of the 401 Certification for this
Phase of the project and is subject to the requirements below.
1. The Division approves the SMP consisting of one (1) wet detention basin (wet pond) and all associated
stormwater conveyances, inlet and outlet structures, and grading and drainage patterns depicted on
plan sheets dated February 1, 2017 and updated plan sheets submitted on April 4, 2017, which are
incorporated by reference and are enforceable by the Division. The following conditions also apply
[15A NCAC 02H .0506(b)(5)]:
a. The maximum allowable drainage area for the approved Pond shall be 1,166,675 square feet
and the maximum allowable built -upon area within that drainage area shall be 465,296 square
feet. Any changes to these maximum areas shall require the applicant to submit and receive
approval for a revised stormwater management plan by the Division. [15A NCAC 02H

b. The footprint of all stormwater management devices as well as an additional 10 -foot wide
area on all sides of the devices shall be located in either: public rights-of-way; dedicated
common areas; or recorded easement areas. The final plats for the project showing all such
rights-of-way, common areas and easement areas shall be in accordance with the approved
plans. [15A NCAC 02H .0506(b)(5)]
c. The approved SMP shall be constructed and operational before any permanent building or
other structure is occupied at the site. [15A NCAC 02H .0506(b)(5)j

d. The SMP may not be modified without prior written authorization from the Division. [15A
NCAC 02H .0506(b)(5)]
e. Maintenance activities for the wet detention basin shall be performed in accordance with the
notarized O&M agreement signed by Mr. Bret Mangum on February 27, 2017. The 0&M
agreement shall transfer with the sale of the land or transfer of ownership/responsibility for
the BMP facility. The Division shall be notified promptly of every transfer. [15A NCAC 02H
.0506(b)(5)]
f. The applicant and/or authorized agent shall provide a completed Certificate of Completion
form to the Division within thirty (30) days of project completion (available at
https:Hedocs.deq.nc.gov/Forms/Certificate-of-Completion). [15A NCAC 02H .0506(b)(5)]
g. In accordance with Session Law 2011-256, the Homeowner's or Property Owner's Association
shall be eligible to assume the responsibility of the stormwater approval conditions from the
permittee at any point in time after at least 50% of the lots or units have been sold to an
individual owner other than the Declarant. The Permittee shall ensure that the HOA/POA
is given a copy of this approval and they are responsible for complying with all
conditions.
