Skvarla, III Secretary RE: Refinement of CAMA Major Development Permit No. 98-11 (TIP No. B-4647) Replacement of Bridge No. 6 over the Northwest Fork of the Alligator River on NC 94, Tyrrell County DearMr. Willis: This letter is in response to your request, dated May 31, 2013, requesting a modification to CAMA Major Permit #98-11, which was issued for the replacement of Bridge No. 6 over the Northwest Fork of the Alligator River on NC 94 in Tyrrell CounTy. According to your letter of request, you would alter the mitigation boundaries on the project based on site conditions and ease of constructability. The area of mitigation of 404 wetlands would remain 0.52 acres as originally proposed. Tliis Letter of Retnement authorizes the revisions to the 404 wetland mitigation area as depicted on the attached design drawings dated October 8, 2012. This letter shall be attached to the original of Permit No. 98-11, which was issued on August 8, 20ll and the Minor Modification issued October 29, 2012. Copies of all documents shall be readily available on site when a Division of Coastal Management representative inspects the project for compliance. All conditions and stipulations of the active permit remain in force unless altered herein. We will stake the area and bring it down to the elevations you marked in the field. Once the work is completed we will mark the mitigation area with signs. I'm going to call it a revision to the original mitigation plan and issued permit. At this point I'm going to say the revised mitigation i project area submitted by e-mail by Clay Willis and Shawn Mebane dated May 2, 2013 is authorized by this e-mail. Note that the original permit conditions are applicable and the only thing this revision is changing/authorizing is the specific location of where the mitigation restoration work is to take place. All of the requirements of the wetland restoration plan dated April 5, 2011 for this project are still required. If you have any questions or concerns please feel free to contact me. Please note the following: 1) We added an area on the south end of the project as discussed in the field meeting. 2) The area between the pipe and creek can be omitted. 3) We deleted some area on the north end of the project as it is already wetland. Richard, there will be some clearing necessary up to the pipe but you will not have to disturbed the pipe. If anyone has any questions please let me know. The area of mitigation will remain 0.52 acres as was originally proposed. The change of the mitigation azea boundaries was based on site conditions and ease of constructability. This included utilizing already cleared azeas and limiting the disturbance of established trees and vegetation adjacent to Northwest Fork Creek while still achieving 0.5265 acres of mitigation azea. Included with this request are existing and proposed plans showing mitigation areas, azea calculations noted by station numbers, and a copy of the CAMA Major Permit.
