West Ellerbee Creek Trail Project — Phase 11; NCDOT TIP: C-5572

The Buffer Authorization approved by DWR on April 12, 2012 for this project has expired (see
attached). The project is a 0.9 mile greenway trail in the Neuse River Basin in Durham, NC.
Portions of the trail are along Ellerbe Creek. The project is funded by the City of Durham and
federal Congestion Mitigation Air Quality funds through the NCDOT.
All NCDOT, USACE, and FHWA project requirements have been met. Required nutrient payments
were also satisfied in 2012. Having satisfied these requirements, NCDOT issued an Authorization
to Construct in September 2016. All contracts were approved earlier this month and the
construction Notice to Proceed was set to be issued May 1, 2017.
Earlier this week I consulted the Authorization Certificate to notify DWR of project
commencement and unfortunately recognized that it had expired on April 2, 2017. Due to the
urgency of this error, I contacted Jason Robinson in Danny Smith's absence. I was advised to re-
submit a Buffer Authorization application.
Please find attached three copies of second Buffer Authorization Form for this project prepared by
Stewart Engineering. No changes have been made to the project since the initial application;
therefore, original attachments on file should be referenced.
