From the information provided with your application, I have drawn the following conclusions: (1) You propose to establish a commercial marine repair business on a 9.88 -acre site located at 101 N. Granby Street near Hertford, NC. [Formerly operated & know as Shore Flyte Marina] (2) Your application & site plan provides details for the first phase of the development which includes construction of docking facilities, travel lift piers, bulkhead work; all of which are represented as "water dependent infrastructure; but does not propose any new upland development. (3) You are aware of the requirement to apply for, and obtain, a Coastal State Stormwater Permit for any proposed upland development, prior to beginning said upland development; upland development meaning any impervious type surface. The previous stormwater permit issued to Shore Flyte Marina for this site has expired. This type of permit would be reviewed & issued by this office. (4) You are aware of the requirement to apply for, and obtain, a separate and different stormwater permit for industrial activities regulated by the Federal Stormwater Rules; more specifically, a permit for marine activities covered by the North Carolina General Stormwater Permit for Marina activities (NCG19). An NCGI 9 permit for marina activities was issued to the previous owner for this site, but is now inactive. An application for coverage under this permit is reviewed by DEMLR & issued from our Central Office in Raleigh. 1 Mr. Rivera and Mr. Goodman, given the scope and complexity of your project, especially the intended use of the site, it would be beneficial to all parties & agencies involved to share & discuss the permit requirements & process through a formal scoping process. Unfortunately this scoping process has not occurred. I understand the sense of urgency to begin construction for the "water dependent infrastructure" and your desire to obtain the necessary CAMA Major permit in a timely manner. However, there are environmental issues & concerns that could be better addressed "upfront" in the review of a project, rather than after development has begun. Mr. Rivera, in order for our office to submit favorable comments to the Division of Coastal Management regarding your CAMA application, we are requesting your comments, questions & general acknowledgement, particularly to items (3)&(4) of this email. You can submit your comments by letter to me at this office. We look forward to working with you and your consultant on this project and will be glad to assist with the permit process in any way we can.
