TROGDON, III SECRETARY Subject: Nationwide Permit #14 Replace Culvert 250453 on SR 1141 (Bingham Drive) with a bridge Cumberland County, North Carolina WBS No. 15006.2026041 Dear Ms. Hair: The North Carolina Department of Transportation (NCDOT) proposes an emergency replacement of Culvert 250453 carrying the waters of a Beaver Creek Tributary under SR 1141 (Bingham Drive) in Cumberland County. The culvert was washed out during Hurricane Matthew. This project has been let as an Emergency Express Design-Build Bridge Replacement due to Hurricane Matthew and construction has begun prior to formal notification to the USACE and NCDWR. The structure is to be replaced by a bridge at its existing location. The existing structure was a 83' long, ll2" x 75" Aluminum Pipe Arch. The proposed structure is a 1@ 40', 1@ 55'-21" cored slab bridge. An off-site detour is proposed. Construction of this project will require impacts to waters of the United States in the Cape Fear River Basin. The culvert crossed a tributary of Beaver Creek, a Class C water. Please find attached the Permit Drawings and associated Stormwater Management Plan. Proposed impacts to the tributary of Beaver Creek include 112 linear feet of permanent stream impact due to bank stabilization and 11 linear feet of temporary stream impact, <0.01 acre of fill in wetland, and <0.01 acre of inechanized clearing in wetland for construction access. This project was reviewed for the presence of threatened and endangered species. No habitat is present for the federally listed threatened and endangered species (see Table 1 below). Table 1. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. The programmatic determination for NLEB for the NCDOT program is "May Affect, Likely to Adversely Affect". The PBO provides incidental take coverage for NLEB and will ensure compliance with Section 7 of the Endangered Species Act for five years for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Cumberland County, where this project is located. This level of incidental take is authorized from the effective date of a final listing determination through Apri130, 2020. This letter and attached Permit Drawings are our notification for USACE and NCDWR 404/401 approval. If further information is required, please let me know.
