Authorizing development in Carteret County at adj. to Taylors Creek, at 2500 Front Street,
in Beaufort , as requested in the permittee's application dated 2/28/08 (MP-1 and MP-2.) and
5/8/08 (MP-4), including the attached workplan drawings (10), 5 dated revised 4/8/08 and 3 dated revised 5/6/08 and 1 dated 1l/l/07
This permit, issued on August 25. 2008 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) In order to protect juvenile shrimp and finfish populations, no excavation shall be permitted between
April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with the Division of Marine Fisheries.
2) Excavation shall not exceed -8.0 feet below normal low water level.
3) No coastal wetlands shall be excavated or filled outside the area indicated on the attached workplan
drawings
4) No excavation shall take place outside the area indicated on the attached workplan drawings.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2011

5) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
6) The spoil area, including the required dikes and other retaining structures. shall be inspected and
approved by the Division of Coastal Management prior to the beginning of any dredge activities.
Shoreline Stabilization
7) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings.
8) The bulkhead shall be constructed prior to any backfilling activities.
9) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
10) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Department personnel.
11) All backfill material shall be clean and free of any pollutants except in trace quantities.
12) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
13) No backfill material is to be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
14) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
Docking Facility
15) Unless specifically altered herein, this permit authorizes the removal and construction of the docks,
piers, and other structures and uses located in or over the water that are expressly and specifically set
forth in the permit application. No other structure, whether floating or stationary, shall become a
permanent part of this docking facility without permit modification. No non-water dependent uses of
structures shall be conducted on, in or over public trust waters without permit modification.
16) In accordance with requirements of the U.S. Army Corps of Engineers, boat slips # 1 and 5 shall be used
as temporary boat slips only. Boats moored in these slips shall be immediately removed at the request
of the Corps of Engineers for purposes of maintenance of the federal channel.

17) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
;y of the structure and the adjacent property owner's riparian access corridor. This corridor is determined
by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.

18) In order to ensure compliance with Conditions No. 17 of this permit, an as-built survey showing the
location and dimensions of the constructed structure, the distance to the neighboring riparian corridors,
and the location of the federal channel, shall be performed on the facility, and copies of the survey shall
be provided to the Division of Coastal Management, within 60 days of completion of construction. Two
copies of the as-built survey shall be sent to the U.S. Army Corps of Engineers Wilmington Regulatory
Field office, within 30 days of completion of construction.
19) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
20) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
21) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
22) This permit authorizes a maximum of seven permanent boat slips and 2 temporary boat slips.
Upland Development
23) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including but not limited to the
removal of existing structures and construction of the dry stack facility and parking spaces associated
with the above referenced property, all as expressly and specifically set forth in the attached permit
application and workplan drawings. Any additional land disturbing activities and/or construction may
require a modification of this permit. Contact a Division of Coastal Management representative at (252)
808-2808 for this determination.
Sedimentation and Erosion Control
24) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
25) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.

NOTE: An Erosion and Sedimentation Control Flan may be required for this project. If a plan is needed,
the plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing
activity. Submit this plan to the Department of Environment and Natural Resources, Land 5s
Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405.
Stormwater Management
26) The Division of Water Quality approval of this project under stormwater management rules of the
Environmental Management Commission is covered by way of Stormwater Permit No. SW8 080657,
which was issued on 8/15/08. Any violation of the permit approved by the DWQ shall be considered a
violation of this CAMA permit.
General
27) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
28) This permit shall not be not be assigned, transferred, sold, or otherwise disposed of to a third party
without the written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No.
080922.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. SAW-
2007-01693-010.
