The site is developed with a hotel and assoicated parking lot and maintained grassed areas. The remainder of the site
consits of undeveloped wooded land and fields. The site is located within a mixed use commercial and residential area of
Chapel Hill, NC.

The purpose of the proposed project is to develop the site with a six story multi -family residential apartment complex and
related amenities.

The overall project consists of developing the site with multi -family six story apartment building, interior roads/sidewalks,
parking areas, recreational areas including pool, a greenway and landscaped areas. In order to facilitate construction of
the apartment complex building/foundation and greenway, it will be necessary to impact portions of three small wetland
pockets. To facilitate construction and development of the site, clearing and grading the site will be necessary. Graders,
haulers, excavators and other heavy equipment will be used during grading and construction of the site.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The proposed project has been designed to avoid impacts to streams, stream buffers and wetlands located on the site,
specifically impacts to Booker Creek and its associated buffer. However, due the limited size of the site, it is necessary to
maximize the number of units and associated revenue from units to make the project economically viable. The project has
been designed to meet Chapel Hill's development ordinance for multi -family apartments. This includes necessary building
setbacks from roads, access point requirements, emergency vehicle turnaround, required breezeways and interior sidewalks.
Additionally, due the project location in a highly urban/developed area, the success of tenant occupancy and appeal is for the
proposed project to be a pedestrian friendly environment. Therefore, interior sidewalks and access to the proposed
greenway/natural area is imperative to the success of tenant appeal of the proposed project.
The proposed project has been designed to utilize areas of permanent fill impact, associated with a greenway, for temporary
construction access. Stormwater retention has been designed to utilize permeable pavement and an underground sand filter
system, thus avoiding impacts to the stream, stream buffer or wetlands associated with stormwater treatment of the site.
The proposed project was designed to avoid permanent fill impacts to wetlands. However, based on the size of the remaining
wetlands, it is reasonably assumed that hydrology could be altered and the remaining un -impacted wetlands may no longer
function as Waters of the US. Therefore, the remaining unaltered wetlands are being considered assumed take by the
applicant. However, it should be noted that alteration of hydrology to these remaining un -impacted wetlands may not occur
and that they would continue to serve as functioning jurisdictional wetlands.
The apartment building, parking areas, stormwater management devices and the majority of the recreational amenities have
been designed to avoid additional impacts to the stream and wetlands located on the site. The remaining approximate 700
linear feet of stream channel are being avoided.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The clearing limits will be staked and silt fence/BMPs will be used. The area of permanent fill impact to wetlands associated
with the proposed greenway will be utilized during construction of the project as temporary access, thus avoiding temporary
impact to additional waters. Following construction, the site will be matted and re -vegetated to prevent sediments from
entering down -gradient waters.

The USFWS identifies the following species as being federally protected in Orange County as of 6.8.15: bald eagle
(BGPA), dwarf-wedgemussel (E), Michaux's sumac (E) and smooth cone -flower (E). Suitable habitat for the bald eagle,
Michaux's sumac and smooth cone -flower are not present on the site. Therefore, we have made a no effeect
determination for these species. Suitable habitat for dwarf-wedgemussel may be present in Booker Creek, along the
western site boundary. Impacts are not proposed to Booker Creek or the majority of the buffer assoicated with Booker
Creek. Additionally, temporary sediment and erosion control measures will be used during construction. Based on the
lack of impact to suitable habitat located on the site and the use of BMPs, we have made a determination of no effect for
the dwarf-wedgemussel.
