The Division hereby withdraws the letter sent to you dated August. 28, 2014 that attempted to define
operating conditions to allow the initiation .of coal ash. removal under your existing NPDES permits. The
letter is being withdrawn due to concerns that were raised by the EPA in the attached September 16, 2014
letter.
Notwithstanding the delay in removing coal ash associated with a modification of your permits, NCDENR
agrees with EPA's suggestion that a modification process may be a better vehicle to initiate this work. If
