The Property is located in Phase I of Regency Park Estates, a residential subdivision developed in late 1980s. The approved subdivision plat which includes the Piepers' lot (Lot 9) was recorded in Book 1989, Page 628, Wake County Registry of Deeds Office on June 2, 1989 (see Attachment 1). The recorded plat also contains confirmation of the Town of Cary's approval of the subdivsion plat for recording (see p. 2 of Attachment 1). 1 am not aware of any permits that were required to be obtained by the developer directly from the Town during that timeframe. However, Town of Cary records do contain a copy of Wastewater Collection Permit No. WQ0002432 issued by the Department of Environment, Health and Natural Resources to the Town of Cary on October 25, 1989 approving the construction and operation of a gravity sewer line to serve Regency Park Estates, and the discharge of collected domestic wastewater from Regency Park Estates into the Town's sewerage system (see Attachment 2). Without question the developer had obtained all required approvals to proceed with development of Phase I of Regency Park Estates well in advance of the Neuse River Buffer Rule. In fact, Phase 1 of the subdivision had already been developed by July 22, 1997, the effective date of the Rule. Not only had roads and other infrastructure been installed, but it appears that residences already had been built on most of the lots prior to the effective date of the Neuse River Buffer Rule. Given that Phase I of Regency Park Estates was an established residential subdivision that had been constructed in accordance with all applicable requirements well before July 1997, the developer clearly acquired a vested right, that runs with the land, to utilize the Property for residential purposes as originally designed and approved. 3600 Glenwood Avenue, Raleigh, NC 27612 • P.O. Karoly June 13, 2008 Page 2 The Property was approved as a buildable residential lot and has always been properly considered as such. The Piepers purchased the Property in June 2002 from James and Susan Ogle (see Attachment 3) who had purchased it from Regency Park Estates, Inc. in August 1997. The Piepers paid the fair market value for a residential lot, as had their predecessors-in-title, the Ogles. Until recently, the Piepers were unaware of any potential application of the Neuse River Buffer Rule to their Property. They purchased the Property in good faith with the understanding and belief it was a buildable residential lot as platted and approved. Their June 2, 2002 property survey obtained prior to purchase did not indicate any stream buffer area, nor had the August 1997 survey obtained by the Ogles in conjunction with their purchase of the Property. The Piepers would suffer significant financial detriment if a residence of similar size and style in keeping with the surrounding lots cannot be built on their property. They purchased the Property in good faith for a substantial sum intending either to construct a residence there or resell the Property as a desirable residential lot. Application of the Neuse River Buffer Rule to the Property would appear to render the lot unbuildable, and would constitute an extremely significant financial loss for the Piepers.
