Dear Ms. Beckwith:
The North Carolina Department of Transportation (NCDOT) is installing and replacing guardrails
in Transylvania Counry along portions of US 276 south of Brevard to the South Carolina state
line. There are hvo locations where culvert estensions are needed to reduce roll-off hazards and
to gain sufficient road sliaulder width for the guardrail installations. NCDOT Division 14 is
seeking authorization to impact streams in those locations.
Enclosed are the Pre-Construction Notification (PCN) Fonn, vicinity map, USGS topographical
maps, plan sheets, photographs, and other peitinent information to assist in your review. Tliis
project was exempt from a cultural resource revie�v (see attached PA for Cultural Resomces
Checklist), but coordination with the NCDOT Human Environment Unit was undertaken and
clearance provided conceming a stone wall that must be buried for the project (correspondence
attached). A Programmatic Categorical Esclusion l�as been prepared for the project due to
federal fnnding.
Carolina noithern flying squirrel (Glnucomys snbrintts coloralus), Appalachian elktoe
(Altrsmidonla rm�e��elim�n), mountain sweet pitclier plant (Scu•racenin rt�brn ssp. jonesit�, small
whorled pogonia (IsoO•ia merleo%ides), spreading avens (Geam rndinnnn), s�vamp pink (Helonias
bullaln), Virginia spiraea (Spirnen vi�giuinnn), rock gnome lichen (G�n�modern�n linenre),
northern long-eared bat (M�riosrs seplenh•ia�alis), and gray bat (Myotis grisescens) are federally
listed threatened or endangered species with currentrecords orthat are considered probable in
Transylvania County.
Appalacliian elktoe mussels occur in some large cool-water streams with moderate to fast flow
and ��latively silt-fi•ee substrates of sand, gravel, and rock. In Transylvania County, it occurs in
the French Broad River near one of the project locations (Site 4) and several miles downstream of

the other project location (Site 21) in the Little River. At both locations the streams are too small
(<1' width) to support mussels or fish. Stream work at Site 4 will be limited to adding 17 feet of
round culvert pipe to tlie outlet of an existing pipe while at Site 21 a round pipe �vill be fed
througli an existing reinforced concrete box culvert (slip-lined) and extend 10' feet downstream
of the existing outlet. There will be little stream disturbance necessary for construction at each
site and exposed soils will be quickly stabilized to minimize erosion. Witl� these considerations,
we believe that a determination of may affect, not likely to adversely affect should be
applicable to the project for Appalachian elktoe due to the location of Site 4.
Caroliva northern flyi��g squin�el and spreading avens are species that are only found in isolated
habitats at elevations of around 5,000 feet and higher. Rock gnome liclien is also typically found
at high elevations, bnt it sometimes occurs on damp rock faces, usually in deep river gorges. The
project sites are at elevations <3,000 feet and damp rock faces required by rock gnome lichen are
lacking.
Small whorled pogonia usually occurs in open, dry, deciduous woods with acid soil, though it has
been found in a diversity of habitats in North Carolina, including along streams. The construction
work will occur witliin existing dishvbed right of way for US 276 and not affect forested areas
where this plant may be found.
V irginia spiraea occurs along rocky, flood-swured river banks, usually in gorges or canyons.
Gravel and rock bars that provide habitat for Virginia spiraea are lacking at the project sites.
Swamp pink and mountain sweet pitcher plants occur in some �vetlands near US 276 in Cedar
Mountain. However, tliere are no wetlands at the project sites.
Transylvania County is within the known range of northern long-eared bats, but Uiere are no
known hibernacula or maternity roosts in tlie region. And, this project is several miles from the
nearest "red hud' for known liibernacula or maternity roosts for this bat in adjoining counties.
This project sliould require the removal of only one large tree and not require bfasting or
percussive activities. And, the culverts are too small to provide roost habitat for bats.
Tlie project is limited to extensions of two culve�ts in small streams. Erosion and sedimentation
control measures will be used and maintained to minimize potential adverse effects on aquatic
habitats. The project is limited in scope and liabitat is lacking for terrestrial threatened and
endangered species. For these reasons and those discussed above, we recommend a no effect
determination for terrestrial tlu�eatened and endangered species.
NCDOT best management practices will be used to minimize and control sedimentation and
erosion on this project. The wnstivction foremai� will review all control measures daily to ensure
erosion and sedimentation is being effectively controlled. If tlie devices are not functioning as
intended, they will be replaced immediately with better devices.
Impacts to Watecs of the United States
At Site 4, the stream is <I foot in width with a poorly-defined channel and subshate of mud and
sand. It flows directly into the French Broad River (DWR Class: B Tr) about 80 feet
downstream. At Site 21 (UT Little River), the stream is about 1 foot wide with a well-defined
channel and substrate of gravel and saud. It Flo�vs about 80 feet to the Little River (DWR Class:
C Tr), which then flows over l5 miles downstream to the French Broad River. The French Broad
River meets tlie definition of a Traditional Navigable Water. For these reasons, we believe the
UT French Broad River and UT Little River are Relatively Pennanent Wateis and are under the

jurisdiction of the U.S. Army Co�ps of Engineers. Li order to constivct the project, it will be
necessary to impact waters of the United States in the French Broad River Basin (HUC
06010105). The impacts are listed in the table below.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative orjudicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be

I don't believe so. Attached is another view of the wall to the northeast and the HPO web print-out (circle with yellow
highlight is the wall). The Raxter house is at second drive up in the photo. I believe there is another home property
between the wall and Raxter House.

Here's a closer view with traffic cones and somebody's arm for a little scale. The culvert under the wall looks like a slip
lined plastic pipe that I believe will just be extended.
