Credit Release— Task 2 Final
Dear Mr. Hutton:
On January 24, 2017, the Division of Water Resources (DWR) issued a 15% nutrient offset
credit release for the subject site for partial completion of Task 2 with no release of buffer
credits. The release was issued with a contingency that the remaining 5% credit release (along
with the buffer square footage that was deducted), will be issued when DWR has confirmed that
the areas voided of planted stems have been planted in accordance with the approved BPDP.
Wildlands Holdings II, LLC (WHII) was to mow the areas void of planted stems, plant adequate
stems and then have DWR perform an onsite visit to confirm plantings have been completed.
On March 29, 2017, Ms. Merritt received notification from WHII that all mowing and plantings
had been completed as required. On April 10, 2017, Ms. Merritt conducted an onsite visit and
verified that all areas had been planted in accordance with the approved BPDP.
According to the MBI, signed on April 19, 2016, the following Project Milestones have been
met, and the corresponding credits shall be released:

2) Mitigation Site Earthwork, Planting & Installation 5%
of Monitoring Devices Completed (Nitrogen & Phosphorus Credits)
2) Mitigation Site Earthwork, Planting & Installation 20%
of Monitoring Devices Completed (Buffer Credits)
By copy of this correspondence, DWR confirms that you have completely satisfied the above
requirements for the above -referenced tract and 20% of your Neuse riparian buffer credits (0.20
x 605,484 ft2 =121,096.8 ft) are now available for sale. Additionally, 5% of your Nitrogen
nutrient offset credits (0.05 x 41,823.561b -N = 2,091.18 lb -N) and 5% of your Phosphorous
nutrient offset credits (0.05 x 2,693.76 lb -P = 134.69 lb -P) are now available for sale.

Please note that nutrient offset credits generated at this site must be used for impacts in
HUC 03020201 of the Upper and Lower Falls Watersheds as defined in 15A NCAC 02B
.0276 within the Neuse River Basin. Additionally, the riparian buffer credits must be used
for impacts in the Neuse River Basin according to guidelines in the new Temporary
Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on
November 1, 2015.
