As part of the development, the client proposes to impact a total of 204.6 linear feet of intermittent stream, and proposes mitigation at a 0.5:1 ratio, obtained from the Division of Mitigation Services (please see supplemental D. Impact Justification and Mitigation, 3c: comments below). The construction of a retaining wall is proposed to minimize additional impacts to the stream; wetland impacts have been avoided. Below is the supplemental information for the PCN Application. B. Project Information and Prior Project History: The project area is an approximate 1.96 acres and identified by Mecklenburg County Parcel Identification Numbers 14905451 and 14905452. The project area is currently undeveloped, wooded land and a parking lot with foundation of a former drive-in restaurant in a relatively commercial and residential area of Charlotte, North Carolina. The proposed project consists of the development of an automotive sales center with associated parking, driveways, retaining wall, and utilities installations. D. Impact Justification and Mitigation, 1a: Proposed impact S1 is a permanent stream impact to an un -named tributary of Little Hope Creek (Permanent Impact A on the impact maps) for the addition of a grocery store and associated parking area. The impact consists of approximately 166.1 linear feet. A 42" culvert is being proposed to divert the stream from under the proposed parking area, where it will daylight into a swale back into the original channel. A retaining wall is proposed to avoid and minimize impacts to the maximum extent possible to the stream and abutting wetlands. Impact S2 (Permanent Impact B on impact maps) is a permanent stream impact to the same un -named tributary of Little Hope Creek, and is a total of approximately 38.5 linear feet. The aforementioned impacts are associated with roadway improvements required by the City of Charlotte. The existing shoulder will be widened, curb and gutter installed, and a pedestrian walkway will be installed. As a result, the shoulder will encroach into the stream bank. The total amount of proposed stream impact is 204.6 linear feet. Based on the proposed impacts of greater than 150 linear feet of stream, compensatory mitigation for the impacts is being requested in the form of payment to the Division of Mitigation Services (DMS) in -lieu fee program. The approval from DMS is attached. D. Impact Justification and Mitigation, 3c: Due to the impairment of the stream, a rating of "Low" on the North Carolina Stream Assessment Method (NCSAM) Form, and consultation with the USACE, the client proposes a mitigation ratio to offset function loss at the ratio of 0.5:1. DMS does not have available credits within the projects watershed; therefore, the client will be required to obtain credits through the use of the DMS 'Extended Service Area'. As a result, the client will double the amount of mitigation purchased, resulting in a final mitigation ratio of 1:1. F. Supplementary Information, 5. Endangered Species and Designated Critical Habitat (Corps Requirement), 5d: ECS performed a habitat assessment to determine if potential habitat for threatened or endangered species was present. Species listed for Mecklenburg County include the Bald Eagle, the Northern long-eared bat (NLEB), Carolina heelsplitter, Rusty -patched bumble bee, Michaux's sumac, Schweinitz's sunflower, and Smooth coneflower. Marginal habitat for the sunflower was noted along the roadsides; however, no individuals of sunflower were identified. With regards to the NLEB, clearing of vegetation will take place as part of construction activities. The site consists of undeveloped, wooded land; however, the majority of the vegetation where the development will take place, is early to mid -successional, resulting in low potential for habitat disturbance. No known hibernation sites are on or within % mile to the project site. According to the USFWS website https://www.fws.gov/asheville/htmis/project_ review/NLEB—in WNC.html, Mecklenburg County is not listed as a county containing confirmed hibernation and maternity sites for this species; therefore, the project meets the 4(d) rule, and any associated exempt take. The project should have no effect on the NLEB. In addition to the reconnaissance, ECS obtained documentation from the North Carolina Natural Heritage Program (NCNHP) Data Explorer and concurrence documentation from the NCNHP dated 01/31/2017. NHP letter is attached. F. Supplementary Information, 7. Historic or Prehistoric Cultural Resources (Corps Requirement), 7b: ECS reviewed the North Carolina State Historic Preservation Office's GIS website (HPOWEB GIS Service). The western portion of the project study area is identified on the NCSHPO website as MK17801 South 21 Drive -In, No. 1 Restaurant (Gone) 2001. ECS contacted Ms. Renee Shearin with NCSHPO via telephone on January 31, 2017 in regards to the website's listing. According to Ms. Shearin, since the structure was demolished, there are no historic resources which would be affected by the project.
