Heath, I'm just back in town today and saw your email. Attached is the permit for 0.77 acre of open water impact covered under
the minor deviation parameter (since it was endorsed by NCWRC) of NWP 3. No mitigation required.
I've also attached the newest version of NWP 3. No hardcopy will follow unless requested.

Let me know if the Corps will classify as open water or bank stabilization. If the Corps permits as bank stabilization, DWR would
require mitigation because it is over 150'. Looks to me like open water impacts though (unless the dam is breached
permanently) and I doubt that will be happening anytime soon.

Monte/Dave,
See attached permit application for the subject bridge. Please be advised that this is the number 1 priority for Division 11. If you
are working on other Division 11 Projects, we'd prefer to have this one first.
This project is a little different than most in that the bridge crosses a large pond with a stream running through it so I listed the
impacts under streams and open water in the PCN. I'm not sure which you preferred so I just covered both. Also, due to the
potential benefits of retaining the lower foot of the causeway, I did not request mitigation. If you just have to have it, let me
know and I will request it.
