The purpose of this letter is to request a modification to the Clean Water Act (CWA) Section 404 Perrrut
issued by the U S Army Corps of Engineers (USACE ) and to the 401 Water Quality Certification issued
by the North Carolina Department of Environment and Natural Resources, Division of Water Quality
(DWQ) This project is currently under construction The North Carolina Department of Transportation
(NCDOT) is requesting a permit modification for the work to be completed at Sites 15C and 16C (see
Mod Sheets 1 - 5 of 5) Copies of Sheet 17 of 35 & Sheet 20 of 35 from the original permit, depictmg the
currently permitted activities at Sites 15C and 16C, respectively, are also attached
Permit Site 15C, Station -L- 267+70 to 11+54-L-RT
To improve the stability of the ditch at this site, NCDOT has re-designed the ditch from a V-ditch
originally permitted to a Lateral Base Ditch There is no change to the permanent wetland or stream
impacts at this site associated with the re-designed ditch There are 82 feet of temporary stream impacts
to an unnamed tributary (UT) to Reedy Creek associated with tying m the ditch The temporary impacts
are depicted on Mod Sheets 2 & 3 of 5, and require no mitigation
Permanent Impacts no change
Temporary Impacts 82 lmear feet of temporary stream impact not previously accounted for
Mitigation no mitigation required

Permit Site 16C, Station 270+32-L
To incorporate a drainage system revision, a 30-inch (750mm) reinforced concrete pipe (RCP) will be
installed in place of the 24-inch (600mm) RCP onginally permitted (Mod Sheets 4 & 5 of 5) There are
no additional temporary or permanent impacts associated with this change in pipe size
The only change in impacts for this modification is the 82 feet of temporary impacts at Site 15C No
mitigation is proposed for the temporary impacts
The revised design does not compromise NCDOT's compliance with the existing permit conditions The
revision has been evaluated for compliance with the avoidance/mimnnzahon cntena and is in compliance
with all previous issues, including the following
• Protected species
• Aquatic Life passage
• FEMA compliance
• Cultural Resources
REGULATORY APPROVALS
The ongma1404 USACE Permit was issued on October 7, 2004, with the most recent modification to the
permit issued on October 10, 2006 The onginal DWQ 401 Water Quality Certification was issued on
September 21, 2004, with the most recent modification issued on July 20, 2007
The NCDOT respectfully requests that the referenced 404 Individual Permit and 401 Water Quality
Certification be modified to reflect the revisions outlined in this letter In compliance with Section
143-215 3D(e) of the NCAC, NCDOT will provide $570 00 to act as payment for processing the Section
401 certification modification application, as previously noted in this application (see Subject line) Five
(5) copies of this application have been provided to DWQ for their review
