On July 8, 2008 North Carolina Division of Water Quality (NCDWQ) representative Rob
Ridings met with North Carolina Department of Transportation (NCDOT) representatives Dan
Duffield and Erica McLamb to discuss the ponding of water east of Site 5 (Design Plan Sheet 5,
Buffer Permit Drawmg Sheet 9 of 10) During this meeting it was determined that the water was
not draining because a roadside ditch had been covered during the construction Dan Duffield
proposed reestablishing the ditch in its previous location to allow the water to dram Rob
Ridings agreed that reestablishing the ditch in its pre-existing location was allowable under the
Neuse Riparian Buffer Regulations as long as non-erosive velocity was maintained The
reestablished ditch will meet the Neuse Riparian Buffer requirements for treatment and non-
erosive velocity
The buffer impacts were permitted to the easement of the project and this activity would occur
within the permitted portion of the project area, therefore no additional impacts would be
incurred (see attached Revised Buffer Permmt Drawmg Sheet 9 of 10 and Design Plan Sheet 5)
Rob Ridings determined that the reestablishment of the preexisting ditch would not require a
permit modification, but requested a letter of notification to NCDWQ with the revised permit
drawings and plan sheets There will be no additional impacts to jurisdictional streams or
wetlands as a result of this activity
