I relayed this information to the consultant and she is interested in resubmitting a revised stormwater management plan (that meets Phase II and NSW requirements) to Apex for your review and approval. After getting approval from you for the revised plan, they would like to then submit it to us to comply with the 401 Certification stormwater requirements. Please let me know if this is an approach will work for you. If so, DWQ may decide to issue the 401 Certification with a condition that they have to obtain your approval before conducting the impact. Thanks, Annette 1 of 1 8/29/2008 10:23 AM 08-0828 White Oak Development AML comments August 28, 2008 The Stormwater Management Plan that was approved by the Town of Apex fails to meet the minimum requirements of its local Nutrient Sensitive Waters Stormwater Program. Because of this, it is not possible for the DWQ to accept the locally approved stormwater management program as meeting the requirements of the 401 Certification Program. Please pursue one of the following two options to meet the 401 Certification stormwater requirements: Submit a revised stormwater management plan to DWQ for review and approval. This stormwater management plan must be designed to remove a minimum of 85 percent TSS and 30 percent TN from the stormwater generated by this project. For each proposed BMP, please provide a completed BMP Supplement Form, with all the required items. The BMP Supplement Forms are available at the following web site: http:Llh2o.enr.state.nc.us/sulbmp forms.htm. 2. Submit a revised stormwater management plan to the Town of Apex for its review and approval. This stormwater management plan must be sufficient to meet the current stormwater program requirements associated with the Town's Nutrient Sensitive Waters and Phase II programs. Then provide documentation of the Town of Apex's approval of the stormwater management plan by providing EITHER: • A valid approval letter from the Town of Apex indicating that the proposed activity has an approved SMP and one copy of the approved SMP, including plan details, calculations and other supporting information, OR • A set of stormwater plan details and calculations stamped as "Approved" by the Town of Apex.
