TROGDON, III SECRETARY SUBJECT: Pre-Construction Notification Pursuant to Nationwide Perxnit #13 and 33 NCDOT Division 9 Bridge Replacement Program Project Bridge No. 300 on SR 1346 over UT to Dutch Buffalo Creek (WSII; HQW), Rowan County, NC WBS Number: 17BP.9.R.61 Dear Mr. Lastinger: We are requesting Section 404 Nationwide Permits (NWP) 13 and 33 for the replacement of Bridge no. 300 with a new bridge at the same location over UT to Dutch Buffalo Creek (WSII;HQV� on SR 1346 (Scercy Rd) in Rowan County. In addition to the PCN application, included are a vicinity, a"No Survey Required" form far Historic Architecture, and a"No Historic Places or Archaeological Sites Present or Affected" form for Archaeological Resources, A NLEB Screening form, perxnit drawings and a stormwater management plan are also included. The project will permanently impact less than OA1 acre of open waters for bank stabilization and tempararily impact 0.01 acre of open water from bridge demolition. Design Standards in Sensitive Watersheds have been implemented for the project. Protected Species The U.S. Fish and Wildlife Service (USFWS) lists Schweinitz's sunflower (Helianthus schweinitzii) as endangered and Northern long-eared bat (Myotis septentrionalis) as threatened for Rowan County. There is habitat in the project area or Schweinitz's sunflower. No species of Schweinitz's sunflower were found during a field survey of the project area on November 12, 2014; therefore it was determined that there will be `no effect' on Schweinitz's sunflower. There is suminer roosting habitat in the existing bridge and the surrounding trees for Northern long-eared bat (NLEB). Anticipated tree clearing impacts for this project are estimated to be minimal. The NCDOT determined that the project `May Affect, but is Not Likely to Adversely Affect' the NLEB. A NLEB Screening checklist is attached. Thus, for the proposed action, NCDOT has committed to the conservation measures listed below: 1. NCDOT has determined that the proposed action does not require separate consultation on the grounds that the proposed action is consistent with the iinal Section 4(d) rule, codiiied at 50 C.F.R. § 17.40(0) and effective February 16, 2016. Section 7 responsibilities are therefore considered fulfilled. Bald Eagles are protected under the Bald and Golden Eagle Protection Act. A field survey of the project study area was conducted on January 14, 2014. No eagles or nests were observed. Therefore, the bald eagle will not be impacted as a result of project construction. By copy of this letter, we also request 401 review and approval from the NC Division of Water Resources with one copy of the application package provided to Amy Chapman, Transportation Permitting Unit Supervisor, and Dave Wanucha, DOT Project Coordinator. Please charge the application fee of $240 to WBS Project No. 17BP.9.R.61. We would like to request a waiver to General Condition no. 20 of General Certification 4085 and 4094, removing the 50' refueling and vehicle maintenance setback. Permanent and temporary impacts to U.T. to Dutch Buffalo Creek (open water due to permanent flooded condition) are unavoidable due to the requirement to replace the bridge with a bridge, stabilize the stream banks and the removal of the existing bridge and abutments. The placement of the bridge from the stream embankments will eliminate the need for heavy equipment to enter the jurisdictional waters of the U.S. and will allow 1 b. As defined by the NCDOT, the survey area (Area of Potential Effects [APE]) for archaeology measures approximately 300 feet (91.44 m) from either end of Bridge No. 300. The corridor is approximately 150 feet (45.72 m) wide, extending 75 feet (22.86 m) on each side of SR 1346 from its present centerline. A map review and site file search conducted by NCDOT on 1 December 2014 revealed that no previously recorded archaeological sites have been identified within the APE. Five previously recorded archaeological sites (31RW55-31RW59) are recorded within one mile of the APE. These sites, identified by a local collector, were reported to the OSA in 1977 by the University of North Carolina at Charlotte. None of the sites' locations have been verified, and none of the sites have been evaluated for their National Register eligibility. A search of the North Carolina State Historic Preservation Office online database (HPOWEB GIS Service) revealed no previously recorded historic architectural resources within the APE that have the potential to yield intact archaeological deposits. Topographic maps, aerial photography, United States Department of Agriculture (USDA) soil survey maps, and historic maps were examined for information on natural or cultural factors that might have affected site location or preservation. The c. 1910 Rural Delivery Routes map shows what appears to be the current road alignment and crossing. The 1914 Soil Survey map for Rowan County also shows a road or crossing in the vicinity of the current bridge. Later maps, including the 1938 and 1953 Rowan County Highway maps, show no apparent changes to the road alignment or bridge. The APE consists largely of wooded areas in the western half of the APE. A portion of the northeastern quadrant of the APE is located within a fenced cow pasture. A portion of the southeastern quadrant of the APE is located within a grassy field. Oriented roughly east-west, Bridge No. 300 and Scercy Road cross the unnamed stream (locally referred to as Beaver Creek), which drains south into Dutch Buffalo Creek within the Yadkin-Pee Dee River Basin. Map units (soil series) are named for the major soil or soils within the unit, but may have minor inclusions of other soils (NRCS 2013). The two soil units mapped within the APE are listed in Table 1. The floodplain of the APE is composed of Chewacla loam (ChA), a nearly level, somewhat poorly drained soil series. The side slopes and terraces on either side of the unnamed stream are mapped as Cecil sandy clay loam (CeB2, 2-8% slopes). Though well drained, this soil series is moderately eroded. Photographs of the project area are shown as Figures 3-8. A systematic visual inspection of the APE was undertaken to search for surface artifacts, above-ground structural remnants, or other signs of cultural activity. A large beaver dam located on the south side of Bridge No. 300 has resulted in the flooding of the majority of the floodplain within the APE. The northwestern quadrant of the APE appears to contain the remnants of an old roadbed running roughly parallel to Scercy Road. The old road bed is slightly elevated, and gravel was encountered in each of the three shovel tests excavated in this quadrant of the APE. The old road likely represents a fortner alignment of Scercy Road. Numerous bridge crossings have been located in this area. According to historic records, this first bridge crossing at this location was likely built around 1910, while the current Bridge No. 300 was constructed in 1972. The northeastern quadrant of the APE is located within a fenced cow pasture and adjacent swamp. Only one shovel test (ST 130) was excavated in this area, near the eastern end of the APE, due to the presence of standing water and hydric soils (flooding from the beaver dam located south of the bridge). ST 130 revealed eroded and deflated soils, with red clay present just under the leaf litter. Two shovel tests (STs 132-133) were excavated in the southeastern quadrant of the APE. ST 132 was located along a grassy hillslope. Soils in this shovel tests were eroded, with red clay subsoil encountered immediately under the root cap. ST 133, excavated in the floodplain, encountered hydric soils and standing water at 10 centimeters below surface. The southwestern quadrant of the APE is located on a steep side slope overlooking Beaver Creek. Only one shovel test was excavated in this portion of the APE (ST 126) due to steep slope and standing water in the flooding within this portion of the APE. ST 126 encountered 10 centimeters of brown sandy clay loam and rock over reddish brown rocky clay. Three shovel tests (STs 127-129) were excavated in northwestern quadrant of the APE. Each of the three shovel tests encountered disturbed soils and gravel, likely associated with the construction and later removal of the former alignment of Scercy Road. Shovel tests measured 30 centimeters in diameter and were excavated to sterile subsoil or the water table. All soils were excavated by natural levels (soil strata) and screened through a 0.25-inch hardware mesh. No artifacts were recovered from any of the shovel tests. Based on the results of the background research and field investigations, no National Register eligible archaeological resources are located within the APE for Bridge No. 300 in Rowan County. It is recommended that this project be allowed to proceed without concern for impacts to significant cultural resources.
