8. PROJECT SUMMARY: The applicant proposes to maintenance dredge an existing
manmade canal system and construct rock groins at the entrance of the canal
system to the river. The applicant also proposes.to install rip rap, construct a
'bulkhead and a wooden breakwater along certain portions of the canal system.

Project Settinq
The proposed project is in Riverview Acres which is a subdivision at the end of Soundneck
Rd. (SR- 1104) in Elizabeth City, Pasquotank County. The subdivision is adjacent to the
Pasquotank River and a series of manmade canals that empty into the Pasquotank River.
The subdivision is 26.1 acres and is 2-3 ft above NWL. Riverview Acres is comprised of 57
lots which mostly are developed with single family residences and have individual septic
systems. The developed lots are vegetated with typical lawn grasses, pine trees and other
ornamental shrubs. The area to the west of the canal system and Riverview Acres is
vegetated with 404 wetland vegetation.
The canal system and the subdivision were developed in the early 1960's. The system
consists of a main entrance canal that connects to the Pasquotank River with several
interior finger canals. There have not been any previous permits issued to maintain this
canal system. There are no known archeological sites in the vicinity of the proposed
development.
On the east side of the main canal there is a portion of shoreline that has existing rip rap.
On the west side of the canal there are jurisdictional 404 wetlands along the inland portion
of the shoreline. Along the finger canals there are some developed lots that have bulkhead
and rip rap shoreline stabilization. Some of these developed lots also have shoreside
docks and mooring facilities. In the shallow portions of the canals some large beds of
Eurasian milfoil were observed.
The waters of the Pasquotank River are classified as SC in this area by the Division of
Environmental Management and are closed to shellfish taking.
The water depths in the Pasquotank River range from -4 ft to -2.6 ft in this area and the
canal water depths range from -0.2 ft to -4.4 ft.
Development Proposal
In order to improve navigation and water exchange in the Riverview Acres canal system
Pasquotank County proposes to. maintenance dredge the canal system and construct
shoreline stabilization along unstabilized portions of the shoreline. The project proposes to
dredge a channel in the existing canal that would be approximately 5,000 linear feet and
approximately. 20-35 ft wide to an average depth of 4 ft. The existing depths in the canal
range from less than 6 inches to 6 ft. The applicant also proposes to dredge a-channel in
the Pasquotank River where the canal system enters the River. The proposed River
channel would be 134 linear feet and 20 ft wide to an average depth of 4 ft. The existing
depth in the River in the area of the project range from -2.6 ft to -4.1 ft. The area will be
excavatedusing a hydraulic dfedge and the spoil will be pumped to an off site spoil
retention structure. The spoil rentention structure will be located on a near by 5.5 acre
agriculture field. The hydraulic dredge will pump influent through a conduit pipe to the
retention structure. The retention structure will consjst of 2 Staging Areas measuring 3.4
acres and 2.1 acres. The first area will receive the influent and will allow for dewatering.
The second area will be used for storage of the spoil until the spoil can be removed and
spread onto the adjacent farm field area.

The project also proposes to place rip rap along 150 ft of shoreline on the western side of
the canal. The rip rap will be place at NWL. Along the wetland portion of the western side
of the canal the applicant proposes to construct a 370 ft wooden or vinyl breakwater
structure to prevent erosion of the wetland shoreline from boat traffic. The breakwater
structure will be placed between NWL and 10 inches below NWL. On the eastern side of
the canal a 335 ft wooden or vinyl bulkhead will be constructed. The bulkhead will be
aligned closely with NWL and at no point will exceed 5 ft below NWL and will maintain no
more than a 2 ft average below NWL. Minimal excavation and backfill will be needed. The
adjoining shoreline between the proposed bulkhead and the river is currently stabilized with
rip rap.
To maintain the dredged channel in the Pasquotank River the applicant proposes to
contruct 2 rip rap groins on either side of the channel. The groin on the eastern side would
measure 100ft and the groin to the west would measure 180 ft.
Anticipated Impacts
The. proposed dredging project will disturb approximately 137,500 sq. ft. of shallow water
bottom in the canal and 2,680 sq. ft. of water bottom in the Pasquotank River in the Estuarine
Water Public Trust Area of Environmental Concern. The project will excavate approximately
10,000 cubic yards of sand from the canal system and river. Turbidity curtains will be used
during the dredging activities. The size of the spoil retention structure is adequate for the
amount of excavated material. The effluent will be discharged to an agricultural ditch that
drains back into the canal system.
The bulkhead, rip rap, and breakwater shoreline stabilization projects will result in the filling of
2,010 square feet of Estuarine Waters (EW) Public Trust Area (PTA) Areas of Environmental
Concern (AEC). The rip rap groins will result in the filling of 1,120 square feet of Estuarine
Waters (EW) Public Trust Areas Area (PTA) Areas of Environmental Concern (AEC). No
navigational impacts are expected. Temporary water turbidity will occur during construction.

Riverview Acres Maintenance Dredging & Shoreline Stabilization Project - Narrative
The Riverview Acres Maintenance Dredging & Shoreline Stabilization Project consists primarily of the maintenance excavation
of the existing channel entrance & canal system located along the Pasquotank River near the Little Flatty River in Pasquotank
County. This work is being proposed to re-connect the existing canal system to the Pasquotank River. Over the past several
years since Hurricane Isabel the entrance channel in the River, the canal system entrance & much of the existing canal
system have silted in significantly & the entrance to the system is not currently navigable except during very high tide events.
Secondary work proposed that is indirectly related to this maintenance dredging project will include the construction of
bulkhead & breakwater shoreline stabilization structures, & the placement of either concrete & rock rip rap groins on both
sides of the entrance channel from the Pasquotank River into the canal system. This additional work is also being proposed to
aid in reducing future siltation & maintaining navigation of the entrance channel & entrance canal areas.
This canal system & subdivision were developed in the early 1960's & consist of 57 individual lots. 52 of these properties are
located on the interior portion of the neighborhood canal system. Many of the properties in the subdivision are built upon & are
occupied by either full time or seasonal residents. Until the canal system & entrance channel became un-navigable, the
system was used by commercial fishing & crabbing operations, as well as recreational boating. Presently, water depths within
the system range between less than 6 inches to near 6 ft.
Due to the expense of the proposed project, this work was not pursued until recently. The County has been in negotiations
with the N. C. Division of Water Resources (DWR) regarding the partial funding of this project & it appears that the County will
receive funding from DWR. In this regard, Pasquotank County, who is administering this project, is commencing the CAMA
Major Permit Application process to attain the necessary permit authorizations to undertake the proposed work.
The project proposes to commence channel maintenance at a distance of approx. 134 ft offshore where present 48 inch water
depths exist. The channel will be restored to a 20 ft width & 4 ft water depth into the canal system entrance. A 4 ft water depth
will be restored throughout the entire canal system where, in many locations, more shallow water depths exist. Portions of the
existing canal system shoreline near the entrance of the system are adjacent to wetlands. It is proposed that these portions of
shoreline be stabilized with a breakwater structure in order to prohibit the shoreline from sloughing off or eroding into the canal
& requiring more frequent maintenance dredging in the future. This structure will also help prevent erosion of the wetland
shoreline from boat traffic. A wooden & I or vinyl bulkhead is also proposed on the east side of the canal near the entrance
along several lots to also prevent future erosion & sedimentation. In addition, a rock groin is proposed for both sides of the
entrance channel in the Pasquotank River.
Dredge spoil material will consist of very fine silty sand. The project proposes to commence outboard dredging during the
upcoming winter dredge season window. Canal system dredging will continue afterwards within the canal system & will utilize
a turbidity curtain if work continues into the dredging moratorium time period. The excavation will be undertaken by hydraulic
dredge & the spoil will be pumped into a 5.5 acre spoil retention structure. This structure will be located on an adjacent
agriculture field & after dewatering, will be graded out on upland areas of the field. The hydraulic dredge will pump influent
through a conduit line placed on matting temporarily across the Bell & Cooper properties to reach the spoil structure on the
Parker property. It is estimated that the proposed excavation will result in the removal of 10,000 cy of spoil material, result in
123,500 sf of bottom disturbance & impact approx. 5,000 If of the canal system. This proposal will result in 3,000 sf of bottom
disturbance in the Pasquotank River.
It is anticipated that the reconnection of the canal system will significantly improve the water quality of the canal system &
restore the canal.waters to public use.
No other development work is proposed at this site within the Estuarine Shoreline, Estuarine Waters or Public Trust Water
AECs of the State.

1. Adiacent Wetlands It was agreed that an entire wetland plat of the subdivision & adjacent related prbp&Wis would not be
required for the application. However, US Army Corps of Engineers (USACE) jurisdiction would need to be depicted in the
proximity of the spoil retention structure, including distances. Plat Figure C303A has been provided which depicts the USACE
jurisdiction wetland boundaries in proximity of the spoil site.
2. Spoil Site Dimensions The spoil site will be located on a nearby adjacent property owned by C. Wayne Parker.- The structure
will be located entirely on an existing upland farm field area. The spoil retention Stage 1 area will be approx. 3.4 acres. This area
will be used for the initial influent settling area. The Stage 2 area will be approx. 2.1 acres & depending upon what phase of
maintenance excavation is underway will be used primarily for storage of spoil solids to allow for additional dewatering before this
material is removed to be spread as dry material on the adjacent upland farm fields owned by Mr. Parker. An approx 1 acre area
directly adjacent to the Stage 2 area will be used for work staging & loading of dry spoil material into dump trucks for further
disposal. It is estimated that approx. 8 acres of upland area will be disturbed related to the actual spoil site operation while
another 3.25 acres of other upland area where dewatered dry spoil material will be spread will be impacted. It is estimated that a
total of 11.25 acres will be impacted.
3. Spoil Site Operation The operation of the spoil site during maintenance excavation & spoil structure operation will include the
installation of turbidity & siltation devices around the entire property. The spoil retention structure will be divided into two cell stage
areas to allow for better manipulation & removal of dredge effluent & dewatered spoil material. The effluent will be discharged by
gravity through a weir discharge structure into an interior ditch. Dewatered solids will be mechanically removed by an excavator to
upland areas or the adjacent staging area for disposal elsewhere on the property on upland areas of the existing farm fields
owned by Mr. Parker. In addition, while influent is being pumped into the retention structure, the berm areas will be manually
monitored to confirm that the permitted free board is maintained & the berm structure remains intact to prevent any un-authorized
spills. A minimum of 30 ft will be maintained between the toe of the structure berm & any adjacent wetland areas.
4. Bulkhead Alignment & Shoreline Stabilization Structures The proposed bulkhead alignment along the developed portions of the
man made canal, where proposed, will approximate the NWL. Some fill may be required to provide a straight alignment. In other
areas some minimal excavation of high ground will be used to provide a straight alignment. A total of 335 ft of bulkhead is
proposed along the northeastern side of the entrance canal along lots owned by Ronald Lutton, Timothy Ennis, & Clarence
Lassiter. The southwestern side of the entrance canal will be stabilized with approx. 370 ft of breakwater constructed with wood
or vinyl sheet piles as shown on plat C303. Also approx.150 ft of rock rip rap will be installed along this same shoreline between
the river & the proposed breakwater, as depicted on Plat C302 & C303.
5. Regular Water Depth Intervals Water depths as shown on Plats C301 & C302 are consistent in between the depicted cross
section stations. The selected stations were chosen to shown both different shoreline conditions as well as water depth changes.

7. Other Previous Dredging within the Riverview Acres Subdivision Canal System I am not aware of any other maintenance
iexcavation that has occurred regarding the entire system. However, I believe that CAMA General Permits were probably issued in
the past to address certain portions of the system, including the entrance.
8. SAV's Since the original platwork was prepared for this application, some SAV have been noted in one portion of the canal
system. Milfoil is present as of June 17, 2008 in Canal A between cross section stations B & C it's intersection with Canal D. It is
estimated that approx. 6,750 sf of Myriophyllum spicatum (Eurasian Milfoil) are present in this area. However, due to the lack of
water circulation in the canal system, much of this vegetation is dying & exhibiting stress symptoms.

Purpose of the project is to restore water depths to an existing canal system & entrance channel from the Pasquotank River.
The waterways are used by adjacent riparian property owners for public trust access for recreational boating & commercial
fishing.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
Entrance channel & canal system will be maintenance excavated with a hydrologic dredge. Spoil will be pumped into an
approved spoil retention structure located on an adjacent upland ag field. The structure will be graded out once the spoil has
been dewatered. No dewatered spoil material will be placed in any wetlands or within 75 ft of any waters. The structure will
be buflt with'a front end loader & dump trucks. The structure berm material will either be barrowed from on site & / or hauled
in from an approved upland pit Effluent waters will be eventually discharged into an adjacent farm field ditch. The hydrologic
effluent will be discharged through a baffle structure & grassed swales to reduce or eliminate the discharge of any solids into
the ditch & state waters or wetlands. The applicant is also in the process of applying for an Erosion & Sedimentation Plan

Thank you for your timely review of the subject application. This correspondence concerns specifically your May 16, 2008 letter
requesting that project area wetlands be identified. During the Department September 19, 2007 scoping meeting representatives
from the Washington District office of the USACE requested that wetlands in the vicinity of the dredge influent line be identified
with the application.
Attached are two supplemental plats (Attachment Figures 1 & 2). These depict the USACE jurisdictional wetlands in the vicinity of
the dredge spoil influent line transect to the spoil retention structure as well as existing wetlands along the southeast side of the
main canal.
