PROJECT SUMMARY: The applicant proposes a major modification of State Permit #61-05 to allow for the construction of a community beach club, consisting of an extension of SE 61St Street, two buildings, an elevated access bridge/driveway, a retaining wall, parking lot, gazebo and beach accessway to serve the Brunswick Forest subdivision. PROJECT DESCRIPTION The applicant's project site is located at the end of 61St Street SE, between 59th and 61St Street SE, in the Town of Oak Island, Brunswick County. To find the project site travel south on US Highway 17 to NC Highway 133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-133.Turn onto Dosher Cutoff and then turn right at Southport-Supply Rd. SE/ NC-133. Travel approximately 0.8 mile and turn left onto NC-133. Travel on NC-133 to Oak Island and turn right on East Oak Island Drive. Travel approximately 1.7 miles to 61St Street SE. Make a left on 61St Street SE and the property will be located on the right. The subject property is 13.03 acres in size and currently is partially developed. The tract is bounded by East Oak Island Drive to the north, the Atlantic Ocean to the south, 59th Street SE to the west and 61St Street SE to the east. The tract is currently divided into two parcels. The Food Lion grocery store currently occupies the 11.06-acre parcel, which is located to the north. A 1.97-acre parcel lies to the south of the tract. The center of the tract has been delineated as jurisdictional §404 wetlands. Wetland vegetation consists primarily of Common Reed (Phragmites australis), Black Willow (Salix nigra) and Wax Myrtle (Myrica cerifera). The elevation increases seaward of the wetland boundary where vegetation transitions rapidly to that characteristic of an upper beach community. Vegetation in this area consists primarily of Wax Myrtle (Myrica cerifera) and Sea Oxeye (Baccharis halimifolia), transitioning seaward to Salt Meadow Hay (Spartina patens), Spanish Bayonet (Yucca aloigolia), Gulf Croton (Croton punctatus) and Sea Oats (Uniola paniculata). A frontal dune, with an approximate height of 5', is located seaward of the static vegetation line. A CAMA major permit (State Permit #61-05) was issued to Food Lion LLC c/o Michael Morse on May 10, 2005 for the construction of the Food Lion grocery store, the extension of SE 61 St Street, four residential oceanfront lots and wooden access bridge. A retaining wall was authorized seaward of the wooden bridge which also allowed for the fill of approximately 0.24 acres of §404 wetlands south (seaward) of the bulkhead. The extension of SE 61" Street authorized the replacement of an existing culvert measuring 24" in diameter and fill of approximately 0.03 acres of §404 wetlands. Approximately 1 acre of §404 wetland was created as compensatory mitigation for the wetland impacts resulting from the project. Both created and existing wetlands were placed in a conservation easement, which included approximately 7.37 acres and was recorded with Brunswick County Register of Deeds on December 21, 2005 (see enclosed copies of the conservation easement and annual wetland monitoring reports). The USACE wetland verification was originally approved on May 15, 2003 (Action ID: 2003300748) and therefore expired on May 15th of this year. The waters of the Atlantic Ocean, adjacent to the project site, are classified as SB by the North Carolina Division of Water Quality. The area is not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. The subject property is located within the Ocean Hazard and High Hazard Flood Area of Environmental Concern (AEC), as indicated by Zone VE (base flood elevation 19') on the Flood Insurance Rate Map. The High Hazard Flood Area (VE Zone) associated with the subject property is contiguous to the Atlantic Ocean. The erosion rate is currently 2' per year. The 100-year storm recession line for the adjacent area is 300 feet, creating a total Ocean Erodible Area of Environmental Concern (AEC) of 420 feet. PROPOSED PROJECT: The permittee is requesting to modify State Permit #61-05 to allow for the construction of a beach club to serve the Brunswick Forest community. Brunswick Forest is located off NC Hwy-17 in Leland, Brunswick County and is approximately 4,900 acres in area. The community is being developed in numerous phases; however, the PUD approved by the Town of Leland allows for approximately 12,000 residential units. The proposed beach club facility consists of two covered clubhouses, each measuring 1,870 square feet in area, with a 6' wide beach access walkway leading to a 21' in length by 10' in width platform. The platform would then lead either south onto the beach via a set of steps, or would continue west to a 9' in length by 8' in width extension, terminating in a covered gazebo, measuring 14' in length by 14' in width (dripline dimensions). The beach access platform and gazebo would be located Food Lion/ Funston Land & Timber- Brunswick Forest Ocean Club Page Three landward of the static vegetation line and would lie partially within the 60' small structure setback. The clubhouse buildings would be located landward of the 60' small structure setback. The eastern clubhouse structure consists of an open space (partially latticed) with an enclosed storage area, measuring approximately 20' in length by 10' in width. A stairway would lead to the main floor, which would consist of covered, open decking (see Sheet 2 of 5). The ground floor of the western building would house an enclosed staircase and an elevator shaft. Vending machines would also be located on the ground floor of this building. The main floor would consist of an enclosed area, measuring approximately 30' in length by 30' in width, housing bathrooms, mechanical equipment and storage areas. An uncovered "bridge" would link the two buildings on the main floor. According to plans, the finished floor level would be approximately 3' above base flood elevation. Utilities would consist of municipal sewer and water. The clubhouses would be accessed via an extension of 61St Street SE leading to an elevated, wooden bridge. A culvert, measuring 36" in diameter, would replace a 24" culvert along the existing road right-of way and two retaining walls would be installed on either side of (parallel to) the road for stabilization and to retain resulting wetland fill. The culvert would be installed 1' below existing grade. The access bridge would be elevated approximately 3' over the §404 wetlands and would measure 4,749 square feet in area. A structurally separate bridge approach/ramp, approximately 600 square feet in area, would lead from the extension of 61St Street SE onto the bridge. This area is currently §404 wetlands. A bulkhead would be located immediately seaward of the bridge, also resulting in the fill of approximately 10,122 square feet (0.23 acre) of §404 wetlands, to allow for the construction of the parking area. An expansion joint would separate two asphalt parking areas, measuring 2,878 square feet and 2,532 square feet in area. The road extension, bridge, bulkhead and resulting wetland fill area were previously approved under State Permit #61-05 to allow access to the four single-family lots originally proposed. However, as previously approved, the culvert to be replaced was the same diameter as the existing culvert (24" in diameter). According to the applicant, a modification of the State Stormwater Permit (# SW8 040113) was approved for the proposed development on January 22, 2008. 10. ANTICIPATED IMPACTS: The bridge would result in the shading of approximately 4,749 square feet of §404 wetlands. The bridge approach would result in the shading/fill of approximately 600 square feet of §404 wetlands. The construction of the bulkhead and resulting backfill would result in the fill of approximately 10,122 square feet of §404 wetlands. The road extension would result in the fill of approximately 957 square feet of §404 wetlands, due to the culvert replacement and retaining wall construction and roadway fill. These impacts were previously approved under the original permit. The project would result in approximately 16,487 square feet of high ground disturbance. The proposed development would be located within the Ocean Erodible Area as well as the High Hazard Flood Areas of Environmental Concern. The construction of the beach club would conceivably lead to a significant increase in traffic due to the number of lots planned for the Brunswick Forest community and the number of people subsequently authorized to use the site. The proposed buildings, parking lot and bridge would meet the applicable setbacks. Submitted by: Heather Coats Date: August 14, 2008 Office: Wilmington Project Narrative CAMA Major Permit- Modification Permit #61-05 Brunswick Forest Ocean Club Oak Island, Brunswick County, North Carolina Funston Land and Timber, LLC and Food Lion, LLC Co-applicants This request for a Modification to the existing CAMA Major Permit (#61-05) proposes a change in use for the existing permit for the construction of an Ocean Club comprised of two covered shelters including bathrooms and shower facilities, 23 space asphalt parking lot, 1 wooden access ramp and elevated wooden deck for parking access, and associated wooden boardwalk with gazebo. The Ocean Club is proposed in the Town of Oak Island, Brunswick County, North Carolina. The proposed work includes the construction of elevated boardwalks, one wooden slatted access platform (4,749 sq. ft.) with access ramp (600 sq. ft.), two asphalt parking areas (2,878 sq. ft. and 2,532 sq. ft.) separated by an expansion joint (see detail 3/A3. 1), two covered club houses (each 1,870 sq. ft.), and an irregularly shaped wooden boardwalk for beach access with a 14' x 14' gazebo (196 sq. ft.). Access to the site will be via 61S` Street which will be extended by the applicant as a private drive in the Town of Oak Island's ROW. The purpose of the proposed Ocean Club is to provide an oceanfront amenity to the Brunswick Forest property owners and their guests. The Ocean Club site is currently undeveloped. The parcel currently proposed for development was previously owned by Food Lion, LLC and was purchased by Funston Land and Timber, LLC and both corporations are listed as Co-applicants on the existing permit. The original Food Lion LLC Permit (CAMA#61-05) included the development of 4 oceanfront homes as well as the construction of the now-existing Food Lion Grocery Store. Wetland fill was authorized for the homesites and store construction (USACE #200400320). Required wetland mitigation is completed and annual monitoring is being performed. The identical wetland fill area for the original homesites is to no 'I' ed E(ub for the Ocean Club facility. There are existing dirt access roads 59'' and 61 tree`s o? Stormwater and Erosion and Sedimentation Control permits have been approved for the proposed upland development of the Ocean Club site. At present the Stormwater Permit SW8 040112 has been modified and approved as of 22 January 2008. Water and sewer service will be provided by Brunswick County. As proposed, the Ocean Club and associated parking lots and boardwalks are located within the 60' and 120' First Line of Vegetation Setbacks. A conceptual plan of what is proposed is included in the attached figures. There is no Coastal Wetland AEC on the property. Existing vegetation on the site consists of native grasses and shrubs. Soils on the property are mapped by the Natural Resource Conservation Service (MRCS) as Newhan fine sand, Duckston fine sand, and Leon fine sand.
