REGAN Secretary S. JAY ZIMMERMAN Director DWR # 2017-0272 Alamance County On March 7, 2017, the Division of Water Resources — Water Quality Programs (Division) received your application dated March 3, 2107, requesting a 401 Water Quality Certification from the Division for your project. The application was submitted in response to a Notice of Violation issued by the Division on December 16, 2016. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: Please provide the Division a copy of your response to March 20, 2017 request for more information from the US Army Corps of Engineers requesting additional information. [15A NCAC 02H .0502(c)]. 2. The PCN indicates that the length of culvert for Crossing #2 will be 83 feet however the culvert report submitted with the PCN indicates the length will be 88 feet. Please clarify the discrepancy. 3. The plans submitted with the PCN form show fill lines, temporary sediment basins, and permanent constructed wetlands that are immediately adjacent to jurisdictional wetlands and state regulated buffers. Please indicate whether these features/measures can be reasonably constructed and permanently maintained (note that stormwater measures require permanent maintenance access) without any impacts to adjacent areas. 4. A number of lots are shown to include jurisdictional wetlands within the lot limits. Please note that the 401 issued to this project will require that deed notifications be filed on these lots to indicate to future owners that any disturbance to these will require proper State of North Carolina I Environmental Quality 450 W. If lots have already been recorded, please indicate so in your response to this letter. 5. Issuance of a water quality certification for a proposed project requires that existing uses are not removed or degraded. On December 16, 2016, 2010, the Division issued a Notice of Violation (NOV) for wetland standard violations as a result of lot fill into a wetland. The NOV required that the wetland boundary be clearly flagged and for an inspection to be scheduled with DWR and the USACE. Please provide a response as outlined in the NOV. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending one copy of all of the above requested information to my attention at the address below. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
