I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit 29 http://saw- reg.usace.army.mil/NWP2017/2017NWP29.pdf. Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1) The proposed cumulative loss of waters of the US (i.e. footprint of fill in streams due to culverts = 149 linear feet) is very close to the compensatory mitigation threshold of 150 linear feet. Our experience in the Piedmont is that proposed impacts approaching the 150 linear foot threshold often exceed it due to surveying errors in the field, culvert lengths delivered on-site, etc. Further, your original PCN submittal on 1/10/2017 proposed only 133 linear feet of fill in streams due to culverts. As such, can additional avoidance measures be taken to reduce the proposed loss of waters of the US from culvert fill? If so, please update the PCN and plan sheets accordingly. If not, please describe why additional avoidance is not practicable per Nationwide Permit Condition 23(a). 2) The rip rap footprint does not appear to show up on the crossing 1 (i.e. northern crossing) plan sheet (Sheet D‐10). Please add this footprint to the plan sheet to clearly show the 27 linear feet of rip rap impacts proposed. 3) Please update plan sheet C-17 to show the proposed dewatering footprint in the stream.
