Dear Mr. Sirs & Madam:
You have our approval, in accordance with the attached conditions and those listed below, to
place fill within or otherwise impact 1.01 acres of wetlands, 212 feet of streams and 61,173.1
square feet (fl) of protected riparian buffers (Zone 1=17,732.8 square feet, Zone 2=43,440.3
square feet) for the purpose of a sewer outfall at the subject property, as described within your
application dated June 11, 2004 and received by the N.C. Division of Water Quality (DWQ) on
June 14, 2004 and the additional information submitted July 26, 2004. After reviewing your
application, we have decided that the impacts are covered by General Water Quality Certification
Number 3374 (GC3374). The Certification allows you to use Nationwide Permit 12 when issued
by the US Army Corps of Engineers (USACE). This letter shall also act as your approved
Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233.
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and
Sediment Control, Non-discharge, and Water Supply, Watershed regulations. Also, this
approval to proceed with your proposed impacts or to conduct impacts to waters as
depicted in your application shall expire upon, expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full `compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion
control measures must be such that they equal, or exceed, the requirements specified
in the most recent version of the North Carolina Sediment and Erosion Control
Manual. The devices shall be maintained on all construction sites, borrow sites, and
waste pile (spoil) projects, including contractor-owned or leased borrow pits
associated with the project.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre-Construction Notification. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur.

4. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the
maximum extent practicable. If placement of sediment and erosion control devices in
wetlands and waters is unavoidable, they shall be removed and the natural grade restored
within six months of the date that the Division of Land Resources has released the
project.
5. No Impacts to Zone 1
No impacts shall occur to Zone 1 of the protected riparian buffers (except for uses and
activities designated as "exempt" within 15A NCAC 02B .0233), unless otherwise
approved by the DWQ.
6. Water Quality Certification(s)
The proposed project must comply with all of the conditions of General Water Quality
Certification(s) (GC) 3374.
7. Certificate of Completion
Upon completion of all work approved within the 46,1 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to
return the attached certificate of completion to the 401%Wetlands Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification, shall expire upon expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved
wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the
approved buffer impacts) shall be referred in writing to the Director for a decision. The
Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
Water Act and the Neuse riparian buffer protection rule as described within 15A NCAC 2B

Dear Mr. Dorney and Mr. Tugwell:
On behalf of the Rhein Interests and St. Lawrence Homes (owners), we hereby request
authorization from the US Army Corps of Engineers (USACE) to use Nationwide Permit 12 for
the subject project to cover temporary impacts to wetlands and jurisdictional waters (i.e., streams,
ponds) for the purpose installing a sanitary sewer. The proposed easement is located north of
Highway 70, approximately 2000 feet northeast of the intersection of Highway 70 and Sherron
Road (SR 1811). Figure 1 shows the location of the alignment on a USGS topographic
quadrangle.
Construction of the proposed sewer line will proceed in accordance with all general conditions
that apply to Nationwide Permit 12, as well as all of the conditions of the 401 Certification
associated with NWP 12. Parallel buffer impacts to Zone 2 are unavoidable due to topographic
constraints and existing utility location, therefore we are requesting buffer compliance from the
NC-DWQ. A Pre-construction Notification Application (PCN) is attached, as well as an agent
authorization form.
The proposed easement (and surrounding properties) was delineated b S&EC nor to finalizing '-?
the construction plans and the USACE agreed with our delineation (AID# 200420413 & AID# r=
200420594). Mr. Steve Mitchell of NC-DWQ has also conducted a site visit to verify our buffer -
determinations. A copy of his letter is attached (DWQ Cert. # 00-1455).
This project consists of the installation of a sanitary sewer line to service the proposed residential
development. The sewer alignment crosses the creeks at a nearly perpendicular angle in order to
minimize impacts. Placement of the sewer line will temporarily impact a cumulative total of 212
linear feet (Impacts 1-5, 9, & 14) of stream channel and 1.01 acres (Impacts 6-13, 15-18) of
wetlands. Please, refer to attached Wetlands Impact Exhibit for individual impact locations and
amounts.

Due to topographic constraints, parallel impacts to Zone 2 of the Riparian Buffer could not be
avoided (see attached justification). Please, refer to attached Neuse Buffer Exhibit for individual
impact locations and areas. The USACE's current policy requires applicants to avoid and
minimize wetland and stream channel impacts to the maximum extent practicable and may
require further compensatory mitigation to offset unavoidable losses forested wetlands due to
utility line installation. The applicant requested a detailed delineation of wetlands present along
the proposed corridor prior to construction in order to avoid wetland impacts wherever possible.
The wetlands and jurisdictional waters (i.e., streams, ponds) will be restored to original contours
following completion of the project and the banks will be reseeded following current guidelines.
Because the applicant will minimize impacts to stream channels by utilizing perpendicular
crossings, and because the proposed impacts are temporary, S&EC does not believe
compensatory mitigation should be required by the USACE for this project. However, if
mitigation is required the applicant proposes payment to the WRP. A request has been sent to
their office concurrent with this application.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property

project consists of residential and agricultural land.

IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts

were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The applicant requested a wetland delineation for the entire project site in order to avoid and
minimize impacts. The USACE's current policy requires applicants to avoid and minimize
wetland and stream channel impacts to the maximum extent practicable and may require further
compensatory mitigation to offset unavoidable losses forested wetlands due to utility line
installation. The applicant requested a detailed delineation of wetlands present along the
proposed corridor prior to construction in order to avoid wetland impacts wherever possible. The
wetlands and jurisdictional waters (i.e., streams, ponds) will be restored to original contours
following completion of the project and the banks will be reseeded following current guidelines.
Because the applicant will minimize impacts to stream channels by utilizing perpendicular
crossings, and because the proposed impacts are temporary, S&EC does not believe
compensatory mitigation should be required by the USACE for this project. However, if
mitigation is required the applicant proposes payment to the EEP. A request has been sent to
their office concurrent with this application.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed. .
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/stnngide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,

preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Because the applicant has avoided and minimized stream channel impacts by crossing
stream channels in a perpendicular fashion, and because the proposed impacts are temporary
and small, S&EC believes that compensatory mitigation should not be required. However, if
mitigation is required the applicant proposes payment to the EEP.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at

Yes, you are correct - zone 1 (inner 30 feet) and zone 2 outer 20 feet. Parallel impacts

the creek. My understanding is there is 2 zones in the Neuse buffer for the state. One
is a 30' buffer(zone 1) that we need to stay out of and a 20' buffer(zone 2) where we can
have impacts. As you know we are limited with the topo in this basin(steep sides to the
creek) that will constrict our corridor for the sewer trunk line. Let me know if this is

I have reviewed the information submitted for the project referenced by the Raleigh Regional Office as
NBR 04-094. An evaluation of the stream features on the property represented on the Durham County
Soils and the USGS East Durham topographic quadrangle map was performed.
The Division of Water Quality (DWQ) has determined that there are numerous surface water features
indicated on the maps that are present on the ground as a streams and therefore subject to buffer
protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and
Maintenance of Existing Riparian Areas, Administrative Code 15A:20B.0233. Features 2, 3, 7, 8, 11, 12,
16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 27, 29, 30, 37, 38, 39, and 40 were determined to be subject within
the tract. Features 1, 4, 5, 6, 9, 10, 13, 14, 15, 26, 28, 31, 32, 33, 34, 35, and 36 are not subject. Please
review the attached delineation map for a correlation of the stream features and their locations within the
property. This onsite determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination that a water body exists and that it is subject
to the buffer rule may request a determination by the Director. Such a request shall be referred to the
Director in writing c/o John Dorney, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, N.C.
27604. Individuals that dispute a determination that "exempts" a surface water from the rule may ask for
an adjudicatory hearing. Action must be taken within 60 days of the date of receipt of this letter.
Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party
(including downstream and adjacent landowners) is notified of the decision. DWQ recommends that the
applicant conduct this notification in order to. be certain that third party appeals are made in a timely
manner.
To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, Post Office Box 27447, Raleigh, N.C. 27611-74.47.
The determination is final and binding unless a request is presented within the 60 days.
