O'Neal & Green: After reviewing your submittal for the above-referenced project, the following items still need to be addressed before an approval can be issued. 1. Your 401 certification states 237' of impact, while the S&EC Notification of Statutory Status to USACE dated 4/28/05 states 250' of impacts. Why the discrepancy? Also, what does "potential wetland" mean? Is this jurisdictional, or possibly subject to Orange County Buffers? 2. Please approximately (No survey required) show Orange County Buffers on all water features in Phase II. No basins are allowed within the buffers, as disturbances there should be minimized. 3. Clearing limits should be shown with tree protection fencing near all three crossings to minimize impacts. 4. No Stormwater Management Plan is required for this project as it is not in the Neuse Basin, unless it was a particular requirement of your DWQ 401 certification (please double-check). Box 52118 Durham, NC, 27717 Subject Property: Tree Farm Subdivision Phase H Cane Creek, 03-06-04, Class WS-II HQW Approval of 401 Water Quality Certification Dear Mr. O'Neal: You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact 237 feet of perennial streams, including upstream and downstream stabilization measures, for the purpose of constructing road crossings at the subject property, as described within your application dated January 28, 2005 and in additional correspondence received by the N.C. Division of Water Quality (DWQ) on April 28, 2005. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3404 (GC3404). The Certification(s) allows you to use Nationwide Permit(s) 14 when issued by the US Army Corps of Engineers (USACE). In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and other regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 Permit. ` This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction i activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters _ is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Culvert Installation Culverts required for this project shall be installed in such a manner that the original stream profiles are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall j be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re- installed correctly. `i Notifications 6. Deed Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or Tree Farm Phase II Subdivision Page 3 of 3 May 5, 2005 buffers approved for impact under this Certification Approval and Authorization Certificate. A sample deed notification can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed notification may be modified as appropriate to suit to this project. 7. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. I apologize for this error, the original application was marked correctly, but the revision was not, due to a computer glitch. This is a large lot subdivision (all lots exceed 10 acres), and the access road thru Phase I is on an upland ridge, therefore no map showing previous wetland or stream impacts is attached, because we do not believe there were any. 2. While a plan at 1" = 200' would be more manageable for you, please find a site plan at 1" = 100' per your request. 3. Road crossings will be constructed per aquatic life passage requirements. The attached conceptual cross sections indicate how compliance will be obtained. 4. Since a USGS vicinity map and a Soil Survey map were attached with the original 1/28/05 application, and that was indicated in the 3/ 10/05 revision, I am not clear on what more you need. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. Both of them have been out there, and there were no impacts in Phase I. Lot lines are shown on the revised plans; they are huge lots. Two or three of the lots have the possibility of driveway crossings in Phase II, but they may be able to be avoided. I don't have any problems with this one. My comments are on FileMaker. We also request written concurrence from the NC Division of Water Quality (NC-DWQ) that the revised project complies with the 401 Water Quality Certification associated with Nationwide Permit 14. A revised Pre-construction Notification Application (PCN) is attached, an agent authorization form was previously submitted. Location The project site is located in the headwaters of Cane Creek in Orange County. The site is north of Orange Grove Road and east of SR 1126. Figure 1 depicts the site on the applicable USGS topographic quadrangle. Proiect History S&EC delineated the wetlands on-site in January of 2005. Since DWQ requires mitigation even for intermittent streams in waters classified as HQW, S&EC does not believe site meetings with DWQ should be necessary. No permits have previously been issued for this project site, so no Action ID numbers currently exist. Only crossing 3 has been revised. Impacts Proposed impacts include stream channel impacts associated with the construction of three road crossings. No impacts are proposed for general lot fill. The proposed impacts are depicted on the attached site plans and are enumerated and described in the attached PCN form. No wetland impacts are proposed for this project. The total cumulative permanent impacts for this project consist of 250 linear feet of perennial/important stream channel. Avoidance The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the thresholds for notification (0.10 acre) of wetlands or if a discharge causes the loss of any open waters. The applicant requested a delineation of wetlands and waters prior to site plan development in order to avoid impacts to jurisdictional areas to the maximum extent practicable. However, due to site constraints, impacts to multiple streams are necessary to access high ground lots. The applicant reduced impacts to channels by aligning the proposed road with an existing dirt road, and avoided wetland impacts altogether. Mitigation No wetland mitigation should be required because no wetland impacts are proposed. NC- DWQ's current policy requires mitigation for any stream channel impacts in HQW watersheds that require notification. The USACE can require stream mitigation for any impact requiring notification. Due to the avoidance of wetland impacts and the minimization of required stream impacts, mitigation at a 1:1 ratio is proposed through payment to the NC-EEP to offset the loss of 250 linear feet of perennial/mitigatable stream channel. The Corps has accepted this ratio. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwctlands/stn-np,ide.htm1. 1. Project History S&EC delineated the wetlands on-site in January of 2005. Since DWQ requires mitigation even for intermittent streams in waters classified as HQW, S&EC does not believe site meetings with DWQ of the Corps should be necessary. No permits have previously been issued for this project site, so no Action ID numbers currently exist. No impacts are proposed for general lot fill. The proposed impacts are depicted on the attached site plans and are enumerated and described in the attached PCN form. No wetland impacts are proposed for this project. The total cumulative permanent impacts for this project consist of 237 linear feet of perennial/important stream channel. Avoidance The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the thresholds for notification (0.10 acre) of wetlands or if a discharge causes the loss of any open waters. The'applicant requested a delineation of wetlands and waters prior to site plan development in order to avoid impacts to jurisdictional areas to the maximum extent practicable. However, due to site constraints, impacts to multiple streams are necessary to access high ground lots. The applicant reduced impacts to channels by aligning the proposed road with an existing dirt road, and avoided wetland impacts altogether. Mitilzation No wetland mitigation should be required because no wetland impacts are proposed. NC- DWQ's current policy requires mitigation for any stream channel impacts in HQW watersheds that require notification. The USACE can require stream mitigation for any impact requiring notification. Due to the avoidance of wetland impacts and the minimization of required stream impacts, mitigation at a 1:1 ratio is proposed through payment to the NC-EEP to offset the loss of 237 linear feet of perennial/mitigatable stream channel. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
