Dear Mr. Flowers:

On January 18, 2006, at your request I conducted an on-site determination to review two features located
on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 213 .0233). The features
are labeled as "C" and "D" and shown as ponds on the attached map initialed by me on January 18, 2006.
Division of Water Quality (DWQ) Staff from the Express Permits program (Debbie Edwards) had
previously conducted an on-site determination of the features. In your letter to the Director dated
December 19, 2005, you requested an appeal of their determination as provided within 15A NCAC 02B
.0233(3)(a).
The DWQ has determined that the pond labeled as "D" (lower pond) on the attached map is subject
to the Neuse Buffer Rule to the extent of the open water area. This would include a 50-foot buffer
surrounding this open water area. The wetlands upstream and outside of the open-water pond
buffer are not subject. The pond labeled as "C" (upper pond) is subject to the Neuse Buffer Rule.
Please note that if either or both of these constructed ponds is drained by removal of the earthen dam(s),
we will be happy to re-evaluate the remaining features for applicability of the Neuse Buffer Rules. This
determination shall replace the determination originally performed.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the
State. If you have any additional questions or require additional information please call me at (919) 733-
9721. This determination is subject to review as provided in Articles 3 & 4 of G.S. 150B.

On behalf of the owner of the subject property (Marlowe & Moye) we request an appeal of the buffer
determination performed by Mrs. Debbie Edwards formerly of the 401 Express Permitting Unit for the
subject property. On December 21, 2004, Mrs. Edwards and I met on site and she determined ponds C
and D to be subject to the Neuse Buffer Rule (see attached USGS & Soil Survey map(s)). However, we
believe the ponds lack the necessary indicators of buffered ponds. Therefore, we request a re-evaluation
of Mrs. Edwards' analysis. Please accept this letter as an official request. We are only appealing the
determination of ponds C and D. We do not disagree with the other determinations throughout the
property. Your help in clarifying the status of the application of the Neuse Buffer Rules to the ponds is
greatly appreciated.
The DWQ project # for this site is EXP# 04-1984. Please contact me at your earliest convenience to

Dear Mr. Mitchell:

On December 21, 2004, at your request I conducted an on-site determination to review two
features located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC
2B .0233). The features are labeled as "A & F" on the attached maps initialed by me on
December 22, 2004.

The Division of Water Quality (DWQ) has determined that the feature labeled as "A" on
the attached maps is subject to the Neuse Buffer Rule, the origin of feature A has been
delineated and identified in the field as flag #S01. Feature F is not subject, however, ponds
C, D and E are subject. All other features located on within these property boundaries
were not contested and therefore remain subject to the Neuse Buffer Rule. These features
and their associated buffers should be identified on any future plans for this property. The owner
(or future owners) should notify the DWQ (and other relevant agencies) of this decision in any
future correspondences concerning this property. This on-site determination shall expire five (5)
years from the date of this letter.

Landowners or affected parties that dispute a determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a determination by the Director shall be referred to
the Director in writing c/o John Dorney, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd.,
Raleigh, NC 27604-2260. Individuals that dispute a determination by the DWQ or Delegated
Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. Applicants are
hereby notified that the 60-day statutory appeal time does not start until the affected party
(including downstream and adjacent landowners) is notified of this decision. DWQ recommends
that the applicant conduct this notification in order to be certain that third party appeals are made
in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter

On December 7, 2004, the Wetlands/401 Unit of the Division of Water Quality received a Fax/email
request from Soil & Environmental Consultants, PA regarding a stream origin call fora project known as
"Bethlehem Road" for acceptance into the Express Review Program. This letter advises you that your
project will be accepted into the Express Review Program once the following items are received 1) a fee
of $200.00 made payable to the North Carolina Division of Water Quality, 2) four complete and collated
copies of the most recent versions of the NRCS Soil Survey map and the 1:24,000 USGS Topographic
map for the site, both with the property boundaries. located, and 3) a vicinity map clearly marking the
location of the site. Thank you for your attention to this matter.
Please keep in mind that the clock for this project will not start until receipt of the completed application
package and required fee are received.
