III. Project Information

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

9. Describe the existing conditions on the site and general land use in the vicinity of the project
at the time of this application: The site is primarily an undeveloped, wooded tract. The
southeastern portion (single-family) of the site is currently being cleared to connect to
adjacent properties, however no impacts to jurisdictional areas or buffers have occurred. An

existing power line easement crosses the site and a sewer easement also exists on the
property.

Describe the overall project in detail, including the type of equipment to be used: The
proposed project is a single-family and town home residential subdivision with the typical
utilities (i.e. sewer, water, electric, etc.). A proposed water line will temporarily impact 21
linear feet of stream as well as 0.049 acre of Neuse River riparian buffers. Downing Village
also proposes a footbridge crossing of Indian Branch as part of the town's reg enway system,
which will impact 0.093 acre of Neuse River riparian buffers and an open bottomed bridge
road crossing which will impact 0.2 acre of Neuse River riparian buffers. Neither bridged
crossing will result in the impact of any iurisdictional waters. Heavy machinery typically
used for land clearing and road construction will be used for this project.
10. Explain the purpose of the proposed work: The purpose of the proposed water line is to
provide water to the homes in the northwest part of the property. The purpose of the open
bottomed bridge is to provide access to the homes in the northwest pat of the property. The
reg enway crossing is necessary to incorporate the new development into the town's existing
greenway network.

IV. Prior Project History

If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules. Ms. Deborah Edwards with the NC-DWQ visited the site on July 24,
2002 to determine the starting point of riparian buffers (NBRRO 02-152). On December 11,
2003, Ms. Andrea Wade with the USACE made a jurisdictional determination on the site (AID
200320868).

V. Future Project Plans

Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
No future impacts are expected at this time.

VI. Proposed Impacts to Waters of the United States/Waters of the State

It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from

riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an
accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation map, whether or not impacts are proposed to these systems.
Wetland and stream evaluation and delineation forms should be included as appropriate.
Photographs may be included at the applicant's discretion. If this proposed impact is strictly for
wetland or stream mitigation, list and describe the impact in Section VIII below. If additional
space is needed for listing or description, please attach a separate sheet.

1. Provide a written description of the proposed impacts: The proposed water line
(impact 3) will temporarily impact 21 linear feet of stream as well as 0.049 acre (Z1-1302
s.f_, Z2-812 s.f) of Neuse River riparian buffers and will meet all conditions of General
Certification 3374, therefore written 401 approval is not requested. The proposed arch-
culvert road crossing (impact 2 will impact 0.2 acre (Z1-5369 s.f. Z2-3544 s f, of Neuse
River riparian buffers. The proposed reg enway bridge crossing (impact 1) will impact 0.028

VII. Impact Justification (Avoidance and Minimization)

Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts. The applicant requested a
detailed wetland and Neuse River Buffer delineation of waters on-site prior to site plan
development in order to determine the extent and location of wetlands, streams, and buffers. The
detailed wetland delineation determined that no wetlands existed within the proposed impact
locations The proposed water line is necessary to provide water to the homes in the northwest
corner of the property. The applicant initially proposed placing the waterline crossing within the
road crossing's footprint in an effort to avoid additional buffer impacts however, the town will
not allow the waterline to be suspended beneath the proposed road crossing and will not allow

the waterline to be installed beneath the road crossing for access and maintenance purposes so
the water line must be placed adjacent to the proposed road crossing. The water line will cross
the intermittent stream at an approximately perpendicular angle to minimize the impacts during
construction. No wetlands exist within the proposed impact areas. The impacts to buffers
resulting from the proposed waterline, road crossing, and rely crossing were minimized by
crossing at approximately perpendicular angles.

VIII. Mitigation

DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.

If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.ne.us/ncwetiands/strmgide.htm].

1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
The jurisdictional areas have been avoided to the maximum ''extent practicable.
Typically, temporary impacts due to a utility crossing do not require mitigation, therefore no
mitigation is proposed.

Downing Village project will total 38.83%. The stormwater plan is depicted on the attached
grading map but because a 401-permit is not required DWQ approval of the stormwater plan is
not required. The site does however have to meet the local municipality's stormwater
requirements and will also have diffuse flow devices (see attached worksheets) that comply with
DWQ's standards.

wastewater generated from the proposed project, or available capacity of the subject facility.

Quality on October 3, 2002, version 1.6. The draft states that most residential subdivisions are
unlikely to cause cumulative impacts. Downing Village Subdivision does not meet any of the
three criteria of private projects that can clearly result in cumulative impacts. We anticipate that
you will advise us if a qualitative or quantitative impact analysis is required.

Dear Mr. McMillan:

This letter is in response to your letter dated October 11, 2005 (copy attached), which
requested additional information for the proposed development. Your comments/requests
are stated below and followed by our response.

Additional Information Requested:

1. Please indicate the diffuse flow provisions on the site plan.

Level spreaders and detention basins were shown on the overall sit plan previously
provided to your office. The level spreaders were labeled as FES #5, FES #6, and
FES #14 and correspond to the worksheets attached (see below comment).

2. Please provide the details and calculations for the proposed level spreaders.

Please see the attached copies of the level spreader worksheets.

3. An approved stornrivater plan is required by the DJVQ per 15A NCAC
2B. 0233(5), and as described in our April 14, 2004 correspondence to
D.R.Horton requesting more information.

GC 3402 requires a written stonnwater plan approval from DWQ however this
application is not re uesting a GC 3402. GC 3374 is being requested and does not

Dear Mr. Berger:

On September 29, 2005, the Division of Water Quality (DWQ) received your application dated
September 29, 2005, to impact 21 linear feet of streams and 12,242 square feet of Neuse River basin
riparian buffers to construct the proposed waterline delivery, bridge to the northwest portion of the subject
property and greenway connection to the town's existing greenway network. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below. The
DWQ will require additional information in order to process your application to impact protected
wetlands and/or streams on the subject property. Therefore, unless we receive the additional information
requested below, we will have to move toward denial of your application as required by 15A NCAC 2H
.0506 and will place this project on hold as incomplete until we receive this additional information.
Please provide the following information so that we may continue to review your project.
Additional Information Requested:

This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not

Dear Mr. Berger:
On September 29, 2005, the Division of Water Quality (DWQ) received your application dated
September 29, 2005, to impact 21 linear feet of streams and 12,242 square feet of Neuse River basin
riparian buffers to construct the proposed waterline delivery, bridge to the northwest portion of the subject
property and greenway connection to the town's existing greenway network. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below. The
DWQ will require additional information in order to process your application to impact protected
wetlands and/or streams on the subject property. Therefore, unless we receive the additional information
requested below, we will have to move toward denial of your application as required by 15A NCAC 2H
.0506 and will place this project on hold as incomplete until we receive this additional information.
Please provide the following information so that we may continue to review your project.
Additional Information Requested:

1. Please indicate the diffuse flow provisions on the site plan.

2. Please provide the details and calculations for the proposed level spreaders.

3. An approved stormwater plan is required by the DWQ per 15A NCAC 2B.0233(5), and as
described in our April 14, 2004 correspondence to D.R. Horton requesting more information.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Eric Kulz of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we
will assume that you no longer want to pursue this project and we will consider the project as withdrawn.

This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian McMillan at 919-733-

Approval of 401 Water Quality Certification and Authorization Certificate per the Neuse River
Buffer Protection Rules (15A NCAC 2B .0233) with Additional Conditions

Dear Mr. Berger:
You have our approval, in accordance with "the attached conditions and those listed below, to place fill
within or otherwise impact 21 linear feet of perennial stream, 7,531 square feet (ft) of protected Zone 1
Neuse River basin riparian buffer and 4,711 square feet (ft) of protected Zone 2 Neuse River basin
riparian buffer as described in your application received by the Division of Water Quality (DWQ) on
September 27, 2005, with additional information received by the DWQ on December 12, 2005, February
28, 2006 and March 29, 2006, for the purpose of constructing a waterline to the northwest portion of the
site. After rgviewing your application, we have decided that the impacts are covered by General Water
Quality Cert1fication Number(s) 3374 (GC3374). The Certification(s) allows you to use Nationwide
Permit(s) NAV12 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as
your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 213
.0233. In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, and Non-discharge regulations. Also, this approval to proceed with your proposed impacts
or to conduct impacts to waters as depicted in your application shall expire upon expiration of the
404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying'", ith all conditions. If total fills for this project (now or'in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached
certification'. and any additional conditions listed below.

2. No Waste, Spoil, Solids, or Fill of Any Kind

No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Pre-Construction Notification. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards,
statutes, or rules occur.

3. Erosion and sediment control practices must be in full compliance with all specifications governing
the proper design, installation and operation and maintenance of such Best Management Practices in
order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sedinent and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
c. Sufficient materials required for stabilization and/or repair of erosion control measures and
stormwater routing and treatment shall be on site at all times.
4. Sediment and Erosion Control Measures

Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored within six months of the date that
the Division of Land Resources has released the project;
5. Protective Fencing

The outside buffer, wetland or water boundary and along the construction corridor within these
boundaries approved under this authorization shall be clearly marked with orange warning fencing
(or similar high visibility material) for the areas that have been approved to infringe within the
buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15A
NCAC 2B .0233 and GC 3404;
6. Diffuse Flow (No Review)

All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at
non-erosive velocities through the protected stream buffers such that it will not re-concentrate
before discharging into a stream as identified within 15A NCAC 213 .0233 (5). If this is not

possi t ble, it may be necessary to provide stormwater facilities that are considered to remove
nitrogen. This may require additional approval from this Office.
7. DWQ Policy Regarding Stormwater Discharge Into An Adjacent Property's Stormwater BMP

You grave our approval to discharge stormwater from your site into an adjacent property's
stormwater BMP's for treatment as described in your application materials.

8. Deed Notifications

Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands,
waters and protective buffers in order to assure compliance for future wetland, water and buffer
impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or
buffers approved for impact under this Certification Approval and Authorization Certificate. A
sample deed notification can be downloaded from the 401/Wetlands Unit web site at
http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed notification may be modified
as appropriate to suit to this project;

8. Construction Stormwater Permit NCGO10000
Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land
Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an
NPDES General stormwater permit (NCGO10000) administered by DWQ is automatically issued
to the project. This General Permit allows stormwater to be discharged during land disturbing
construction activities as stipulated by conditions in the permit. If your project is covered by this
permit [applicable to construction projects that disturb one (1) or more acres], full compliance
with'permit conditions including the sedimentation control plan, self-monitoring, record keeping
andeporting requirements are required. A copy of this permit and monitoring report forms may

9. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.

Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration o the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.

Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B.

Not really becausQ Nve don't feel that the diffuse flow measures should be required. Thcy just wanted to give
something back to help John feel more comfortable with the approval. The stormwater devices are required by the
Town of Cary.

I think there's also. a matter of semantics involved here - diffuse flow measures are actually one of many types of
stormwater control. John has not asked you to develop a full-blown stormwater management plan and ponds for the
property, has he?
No, but the project no longer requires written concurrence from DWQ for GC3402 (because the current plans use
an open bottom culvert) and as such does not require compliance with Condition No. 4 of GC3402 ; and because
they are dischargitw to existing conveyances "diffuse flow" should not be an issue either.

Project that you emailed me back about yesterday (DWQ Project
#2004-0531). !
The project is requesting a buffer authorization certificate for a road
crossing thatlproposes the use of a bottomless arch culvert bridge (no
stream impacts). (Also, there is a NWP 12 that the USACE has issued an
approval for that meets all of the conditions of GC 3374 and does not
require prior written concurrence from DWQ.)
I understand that the only thing that is holding up your approval is the
stormwater treatment information that you requested in two locations.
After our meeting in your office in February we realized that the
stormwater inithese two locations discharges into existing adjacent
stormwater networks. We most recently responded to your request on
February 28th and I understand that it's on your pile of things to do
and that you were hoping to get to it soon.
The client neeeds an approval by Friday. Is this possible?
I'm not trying to be difficult, but this thing really has been dragging
on for months!. As you know, our position is that the two discharge
locations in question are not regulated under the Diffuse Flow provision
of the Neuse Buffer Rule given that they are to existing stormwater
conveyances at least t 500 feet from the closest buffer. However, we
believe that iie have provided the adequate treatment that you requested
anyway. !
Anything that you could do to help expedite this approval process would

Dear Mr. Dorney and Mr. McMillan:

This letter is in response to your letter dated February 2, 2006 (copy attached), which requested additional
information for the proposed Downing Village Residential Development. The two primary areas of your
stonnwatcr concern arc shown on the attached inset maps. Upon review of the plans, it was discovered that
these two areas are draining to existing stormwater facilities/networks on adjacent sites.
The Dry Detention Basin on the southern property line is draining into an existing Dry Detention Basin (see
attached map) and is greater than 800 feet to the nearest buffered drainage.
The stormwater outlet along the eastern property line outlets an underground detention device. The outlet
releases to a grassed swale that drains to an existing offsite stormwater network that exists to the east of the
property.

This information was not presented to DWQ iri the earlier submittals. It has been our understanding that
tying into existing stormwater does not require DWQ approval thereby not requiring stormwater approval
for this site. The diffuse flow provisions will be met on site using the level spreaders previously described.
We then request that the Neuse Buffer Compliance letter be issued.

The Division received a response to our October 11, 2005 letter on December 12, 2005
from Mr. Sean Clark of Soil and Environmental Consultants. Unfortunately, this response did
not address our questions about the proposed stormwater management plan for this site that is
required under the Neuse River Buffer rules (15A NCAC 26 .0233). Mr. Clark and I have been
unable to talk directly mainly due to my schedule although we have traded voice mails. I think
that a meeting with your stormwater engineer, will be needed to address our questions about
stormwater management for this site. Please have your engineer and Mr. Clark call or email me
with possible times to meet to discuss this issue so we can get it resolved and issue the

Dear Mr. Dorney and Mr. McMillan:

This letter is in response to your letter dated February 2, 2006 (copy attached), which requested additional
information for the proposed Downing Village Residential Development. The two primary areas of your
stormwater concern are shown on the attached inset maps. Upon review of the plans, it was discovered that
these two areas are draining to existing stormwater facilitics/networks on adjacent sites.
The Dry Detention Basin on the southern property line is draining into an existing Dry Detention Basin (see
attached map) and is greater than 800 feet to the nearest buffered drainage.
The stormwater outlet along the eastern property line outlets an underground detention device. The outlet
releases to a grassed swale that drains to an existing offsite stormwater network that exists to the east of the
property.

This information was not presented to DWQ iri the earlier submittals. It has been our understanding that
tying into existing stormwater does not require DWQ approval thereby not requiring storrwater approval
for this site. The diffuse flow provisions will be met on site using the level spreaders previously described.
We then request that the Neuse Buffer Compliance letter be issued.

This letter is in response to your letter dated February 2, 2006 (copy attached), which requested additional
information for the proposed Downing Village Residential Development. The two primary areas of your
stormwater concern are shown on the attached inset maps. Upon review of the plans, it was discovered that
these two areas are draining to existing stormwater facilities/networks on adjacent sites.
The Dry Detention Basin on the southern property line is draining into an existing Dry Detention Basin (see
attached map) and is greater than 800 feet to the nearest buffered drainage.
The stormwater outlet along the eastern property line outlets an underground detention device. The outlet
releases to a grassed Swale that drains to an existing offsite stormwater network that exists to the east of the
property.

This information was not presented to DWQ iri the earlier submittals. It has been our understanding that
tying into existing stormwater does not require DWQ approval thereby not requiring stormwater approval
for this site. The diffuse flow provisions will be met on site using the level spreaders previously described.
We then request that the Neuse Buffer Compliance letter be issued.

We talked about this one briefly. Greater than 30% impervious (38.83%). Request For
More Info letter dated 12/12/05 says "An approved stormwater plan is required by the
DWQ per 15A NCAC 2B .0233(5)". This section of the rule simply requires diffuse
flow. They provided plans showing level spreaders and detention basins, and also
provided level spreader worksheets in their response.
I can't see where we have the "hook" to require a stomwater plan and notrogen
removal. For NW 12, the corresponding GWQC is 3374, which does not have the
stormwater condition. Cyndi pretty much agreed with me. John, however, mentioned
that we did have the authority under the buffer rules to require nitrogen removal
and an approved stormwater plan. You may want to consult John and Cyndi and let them
work it out.
I have no issues with the impacts (extremely minimal), and recommend issuance once
the stormwater thing is worked out.

On September 29, 2005, the Division of Water Quality (DWQ) received your application dated
September 29, 2005, to impact 21 linear feet of streams and 12,242 square feet of Neuse River basin
riparian buffers to construct the proposed waterline delivery, bridge to the northwest portion of the subject
property and greenway connection to the town's existing greenway network. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below. The
DWQ will require additional information in order to process your application to impact protected
wetlands and/or streams on the subject property. Therefore, unless we receive the additional information
requested below, we will have to move toward denial of your application as required by 15A NCAC 2H

NOTICE OF WITHDRAWL

Dear Mr. Spivey:
On April 6, 2004, you requested a 401 Water Quality Certification from the Division of Water
Quality (DWQ) for your project. We wrote to you on April 14, 2004 discussing concerns that we
have regarding the design of the project and stating that it would be placed on hold for three weeks
giving you time to address DWQ's concerns. As of today, DWQ has not received a response to this
request. Therefore, your file is hereby considered withdrawn and will not be reviewed until DWQ's
earlier concerns are addressed. Once you have collected sufficient information to have a complete
application (please see our April 14, 2004 letter for the missing information), you will need to reapply
for DWQ approval. This includes submitting a complete application package with the appropriate
fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this
activity and any work done within waters of the state would be a violation of North Carolina General
Statuses and Administrative Code. Please call Mr. Ian McMillan at 919-715-4631 if you have any
