PROJECT SUMMARY: The applicant proposes to grade the property, construct two duplex units w/ utilities and infrastructure, access pier, platform and docking facility. PROJECT DESCRIPTION The applicant's property is located at 203 and 205 E. 16th Place, adjacent to Montgomery Slough, in the Town of Oak Island, Brunswick County. To find the property, take Highway 17 South from Wilmington and turn left on N.C. State Highway 87. Head south on Hwy 87 and turn right onto E. Oak Island/Yaupon Drive. Travel west approximately one to two miles and turn left onto SE 79`h Street (turns into E. Beach Drive). Continue along E. Beach Drive and turn right onto 14th Place East and take the next left on E. Pelican Drive. The subject property will be located at the far end of E. Pelican Drive at the intersection of E. Pelican and 16th Place East. The undeveloped properties total approximately 2.32 acres, and are dominated by Section "404 type" wetlands and Coastal Wetlands. Approximately 3/4 of the site contains Section "404 type" and Coastal Wetlands, as indicated on the wetlands delineation map. The remainder of the property is vegetated and contains scrub vegetation including Long-leaf Pine, Live Oaks, Cedar and Wax Myrtle. Vegetation within the "404 type" wetlands consists of Marsh Elder (Iva frutescens), Wax Myrtle (Myrica cerifera), Marsh Pennywort (Hydrocotyle umbellate) Fragmites and Groundsel (Baccharis hamilifolia). A small stand of coastal marsh, consisting mostly of Smooth Cordgrass (Spartina alterniora) and Spike Grass (Distichlis spicata) exists along the southern side of Montgomery Slough and a vast span of coastal marsh (Smooth Cordgrass and Black Needlerush) exists between Montgomery Slough and Davis Canal. The site ranges in elevation from 3' to 5' above Normal High Water (NHW). The Division of Water Quality classifies the waters of Montgomery Slough and Davis Canal, which are located immediately adjacent to the project site, as SC. This area is designated as a Primary Nursery Area by the Division of Marine Fisheries and according to maps provided by the Shellfish Sanitation Section, the area is CLOSED to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to develop the two Lots by constructing two (2) duplex units, one on each Lot with a footprint of approximately 2,976 sq. ft. According to the site plans, the roof of the structures (total height) would be approximately 33' above grade. Access to the units would be provided by two entrance drives that would originate along 16th Place East. The units would be constructed just upland of the "404" wetland line bordering Montgomery Slough. Although the units are being proposed in close proximity to the "404" wetlands line, all upland development would be located outside of the 75' Area of Environmental Concern (AEC). As indicated by the applicant, municipal water and sewer would be provided by the Town of Oak Island. In addition to the upland development, the applicant is proposing to construct a 6' x 575' access pier, 10' x 20' upland sitting area, 4' x 63' fixed spine, two-3' x 14' fixed finger piers and four (4) 10' x 12' boatlifts. The pier would originate just upland of the "404" wetlands line, along the common property line of 203 205 16`h Place East. The pier would extend towards the north approximately 575'and cross Montgomery Slough before terminating adjacent to Davis Canal. The pier would span approximately 115' from its origination before crossing Montgomery Slough (which is roughly 26' wide in the vicinity of the proposed pier). According to the application package, the applicant proposes to elevate all structures a minimum of 6' above Normal High Water (NHW) in order to minimize navigation concerns. Approximately 490' from the origination point of the pier, the applicant proposes to construct a 6' x 8' finger pier and 10' x 20' platform over a section of high ground located between Montgomery Slough and Davis Canal. According to the workplan drawings, the entire platform would be located within the confines of the high ground hummock with only the finger pier being located over Coastal Wetlands. The main access pier would continue north beyond the high ground platform for another 80'. The access pier would terminate at the edge of Davis Canal into a 4' x 63' fixed spine, which would run parallel to the Coastal Wetlands/shoreline. The "T-shaped spine" would extend towards the east and west and would provide access to the two 3' x 14' fixed finger piers. The finger piers would provide access to the proposed 10' x 12' boatlifts. According to the workplan drawings, the finger piers and boatlift would be located within % width of the water body and would be located outside of the near shore edge of the channel, within the applicant's area of riparian access. AT Holdings, Oak Island, LLC Page Three Water depths in the vicinity of the proposed docking facility range from 1.25' to -0.05 relative to NLW. The applicant has made efforts to address the water depth issue by installing fixed platforms/pier and boatlifts. Water depths throughout Davis Canal are relatively shallow and this structure would be one, of only a few, that extends beyond Montgomery Slough into a deeper water body. The deepest water in the vicinity of the proposed project, according to the water depth survey, is approximately -2.45' NLW. This depths appears to be the center of the channel and is located approximately 20-30' from the proposed boatlifts. 10. ANTICIPATED IMPACTS The proposed project would result in the disturbance of approximately 13,000 sq ft (0.29 acres) of high ground as a result of house and driveway construction and utilities installation. The construction of the proposed access pier, finger piers and boatlifts would incorporate approximately 3,184 sq. ft. of estuarine waters and public trust area. Additionally, the construction of the access pier would shade approximately 3,468 sq. ft. of "404" and Coastal Wetlands.
