Re: Section 401 Water Quality Certification application
Dear Mr. Siegal:
On July 15, 2008, the North Carolina Division of Water Quality (DWQ) received your application for a 401
General Water Quality Certification to impact 145 linear feet of stream to construct a road crossing and a
temporary crossing for the Robinhood Manor Apartment Complex near Winston-Salem in Forsyth County.
Additional information is required in order that we may determine your project's compliance with 15A NCAC
2H.0500. The DWQ will require this information in order to process your application to impact protected
wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete
until we receive this additional information, and if we do not receive the additional information requested
below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506. Please
provide the following information so that we may continue to review your project.
1. Please provide a more detailed profile view and cross section of the proposed stream culverts.
Please also submit detailed drawings indicating pipe burial. For the permanent crossing, the
Division will require that the natural streambed be routed through only one of the proposed
culverts and the other culvert be constructed as a flood plain pipe and installed at bankfull
elevation or a sill provided on the pipe inlet. Flood plain benches shall be installed at both ends
of the pipe to establish natural channel dimensions above and below the crossing. This
information must all be clearly detailed on the plans and resubmitted to the Division for
approval.
2. Please note that the due to the length of time the temporary crossing will be installed, the
temporary pipe will require proper burial into the stream bed to allow for aquatic life passage.

3. A site visit conducted on August 11, 2008 noted a large bedrock grade control structure in the
stream at approximately the location of the culvert inlet. Please clarify how this structure will
be addressed during installation of the culverts. Please also note that although the Division
typically requires culvert burial, we prefer to avoid blasting into bedrock in or directly below
the streambed for the purposes of pipe burial. You should identify the locations of all bedrock
within the area of the culvert installation.
4. The site visit also noted a sharp turn within the stream channel directly downstream of the
culvert outlet. Additional impacts may eventually be necessary to address the shear stress upon
this streambank. The permit issued to you will require a preconstruction meeting, as well as a
final approval after installation. Additional stabilization work may be necessary at those times.
You may address this situation now if you choose to avoid possible future repairs and permit
modifications.
5. Per the requirements of GC 3705, please enumerate all temporary impacts (in addition to
permanent impacts already indicated) to the stream channel and any wetland areas. Impacts
from the construction of a floodplain bench would be considered temporary impacts
Temporary impacts also include areas of disturbance necessary for proper pipe installation, as
well as any impacts from temporary erosion control measures expected to be installed within
any jurisdictional areas. Please note that temporary impacts should be minimized to the
maximum extent practical.
6. Per the requirements of GC 3705, all work be done "in the dry". Therefore, dewatering
methods will be necessary to temporarily dewater the stream channel during pipe installation.
Please provide a construction sequence that details the method of dewatering to be utilized at
the site and the sequence of construction events to be followed to ensure compliance with this
condition.
7. Per the requirements of GC 3705, this project must comply with Stormwater Management Plan
(SMP) Requirements for Applicants Other Than the North Carolina Department of
Transportation, available at:

OT2.pdf. It appears that this project will be subject to another state implemented program.
Please verify that you have, or intend to, submit a stormwater management plan under that
program.
Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information
to Sue Homewood at the address on this letterhead, and a copy to Ian McMillan N. C. Division of Water
Quality, Wetlands/401 Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. If you will not
be able to provide the requested information within that timeframe, please provide written confirmation that you
intend to provide the requested information, and include a specific timetable delineating when the requested
materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer
want to pursue this project and we will consider the project as returned.
