APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer
Protection Rules (15A NCAC 213 .0233) with ADDITIONAL CONDITIONS
Dear Mr. Radmon:
You have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact 0.003 acres of wetlands, 99 feet of streams and 13,184 square feet (ft) of protected riparian buffers
for the purpose of installing roads and a sewer system at the subject property, as described within your application
dated January 19, 2004 and received by the N.C. Division of Water Quality (DWQ) on January 20, 2004 . After
reviewing your application, we have decided that the impacts are covered by the General Water Quality Certification
Number(s) 3374 & 3402 (GC3374 & GC3402). The Certification(s) allows you to use Nationwide Permit(s) 12 & 39
when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization
Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you should obtain or
otherwise comply with any other required federal, state or local permits before you go ahead with your project including
(but not limited to) Erosion and Sediment Control, Non-discharge, and water supply regulations. Also, this approval will
expire when the accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If
total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.
Conditions:
1. Erosion & Sediment Control Practices - Erosion and sediment control practices must be in full compliance with
all specifications governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must
be such that they equal, or exceed, the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites,
borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated
with the project.
2. No Waste, Spoil, Solids, or Fill of Any Kind -No waste, spoil, solids, or fill of any kind shall occur in wetlands,
waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application.

All construction activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed so that no violations of state water quality standards,
statutes, or rules occur.
3. No Sediment & Erosion Control Measures w/n Wetlands or Waters - Sediment and erosion control measures
shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and
erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade
restored within six months of the date that the Division of Land Resources has released the project.
4. Certificate of-Completion - Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service
Center, Raleigh, NC, 27699-1650.
5. Diffuse Flow - An additional condition is that all constructed stormwater conveyance outlets shall be directed as
diffuse flow at non-erosive velocities through the protected stream buffers such that it will not re-concentrate
before discharging into the stream as identified within 15A NCAC 2B .0233 (5). If this is not possible it may be
necessary to provide stormwater facilities that are considered to remove nitrogen. This may require additional
approval from this Office.
Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts),
you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for
a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final
and binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in
Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the
Neuse riparian buffer protection rule as described within 15A NCAC 2B .0233. If you have any questions, please

Re: Response to the Division of Water Quality's December 5, 2003 letter requesting further
information for the proposed Stonehill Estates, Durham County, NC
Dear Mr. Dorney:
We received your December 5, 2003 letter requesting additional information and have included
the response below.
Items land 3 state that the triple culvert design (Impact 2) will not provide adequate aquatic life
passage and that it appears that the impact can be avoided.
The road crossing has been removed and replaced with a cul-de-sac in order to avoid impacts.
Please refer to the attached PCN and construction drawings for additional information.
Item 2 requests that a storniwater management plan be provided. We provided a storniwater plan
and calculations in our initial application dated October 24, 2003. We are including an
additional copy for your review. Please call if you need additional clarification.

REQUEST FOR MORE INFORMATION
Dear Mr. Radmon:
On October 24, 2003, the Division of Water Quality (DWQ) received your application dated October 24, 2003 to impact
0.19 acres of wetlands, 201 feet of stream and 24,778 square feet (ft ) of protected riparian buffers to construct the
proposed residential subdivision. The DWQ has determined that your application was incomplete and/or provided
inaccurate information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your application as required by 15A NCAC
2H .0506 and 26 .0233(8) and will place this project on hold as incomplete until we receive this additional information.
Please provide the following information so that we may continue to review your project.
Additional Information:
1. Wetland Impact # 2 (Design) - It appears that the triple culvert design proposed will not provide for adequate
aquatic life passage at low stream flow. Also, it appears that you are proposing to relocate the stream flow into the
wetland. Please provide additional information clearing showing how you will provide aquatic life passage, how you
will not destabilize the stream and how you will not alter the flow of the stream or wetland.
2. Diffuse Flow - All constructed stormwater conveyance outlets shall be directed to flow in a diffuse manner at non-
erosive velocities through the entire protected stream buffers without re-concentrating. If this is not possible it may
be necessary to provide stormwater facilities that are considered to remove nitrogen. Please provide a stormwater
management plan for this project. The plan shall specify all stormwater discharge points, plan details, and
calculations to indicate that diffuse flow through the protected buffers or nitrogen removal as described above will
be achieved.
3. Wetland Impact #2 (No Practical Alternatives) - You stated in your letter that "if the impacts are not approved
Durham will allow the use of a cul-de-sac in this location". As such, it appears that there is a practical alternative
that avoids the need for this crossing and it's associated impacts. Please provide additional justification as to why
this crossing cannot be avoided. A letter from the City of Durham justifying the need for the crossing may be
helpful.
Please respond within three weeks of the date of this letter by sending this information to me in writing and Mr. Steve
Mitchell of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn.

On behalf of Durham Land Associates, LLC - Durham, we hereby request authorization
from the US Anny Corps of Engineers to use Nationwide Pen-nit 39 to cover impacts to
stream channels and jurisdictional wetlands (see attached overall map). We also request
written concurrence from the North Carolina Division of Water Quality that the project
complies with the 401 Water Quality Certifications associated with Nationwide Pen-nit
39. A Pre-construction Notification Application (PCN) is attached, which includes an
agent authorization form.
The proposed project consists of impacts from the construction of access roads and a
sanitary sewer connection for a residential housing development. The site is located on
the north side of Highway 98 and the south side of Freeman Rd (SR 1846). The project
lies between Fletcher Chapel Road (SR 1815) and Clayton Road (SR 1825) with the
southeastern property line formed by Little Lick Creek. The site is approximately 112
acres in size, and consists primarily of pine and hardwood stands. Please refer to the
attached USGS map, which displays the location of the proposed project.

S&EC conducted a detailed wetland delineation and Neuse River Buffer evaluation on
June 5, 2003. Maps were sent to the USACE on October 2i, 2003 for approval. Mr.
Steve Mitchell of the NC-DWQ made a site visit and confirmed the buffers on December
4, 2001. A copy of his letter is attached.
The applicant requested a detailed wetland delineation and buffer evaluation on the
property prior to site plan development in order to avoid jurisdictional features and
riparian buffers to the maximum extent practicable. The proposed roadway will impact
approximately 69 linear feet of intermittent channel. A temporary impact of 0.003
acres of jurisdictional wetlands and 30 linear feet of perennial channel is required for a
sanitary sewer connection. These impacts are elaborated upon within the attached PCN
form and are shown on the attached inset impact maps.
The proposed road crossing (impact # 1) is necessary to gain access for the property from
an existing road located east of the site. The road crossing will impact a segment of
intermittent channel and associated buffers. Because the road must "tie into" an existing
road east of the site, the proposed road crossing cannot be constructed perpendicular to
the stream. The sanitary sewer connections (impacts ## 2 & 3) will impact 0.003 acres of
jurisdictional wetlands, a segment of perennial channel, and a portion of the riparian
buffer in order to connect to an existing utility line. These impacts are temporary, and are
a necessary utility for the proposed development. The applicant will minimize impacts
using headwalls at the proposed crossing. Following construction, the applicant will
maintain riparian buffers on the stream channels as well as employ BMP devices to
preserve water quality. Stonnwater will be treated or released as sheet flow (i.e. diffuse)
before entering the buffers. Moreover, because this site is located within a water-supply
watershed, Durliam regulations will not allow >24% impervious surface within the site.
The USACE's current policy requires applicants to avoid and minimize wetland and
stream channel impacts to the maximum extent practicable and compensatory mitigation
to offset unavoidable losses of waters of the US when impacts exceed the requirements
for notification (0.10 acre). The proposed roads are necessary to access the entire
property. Because the applicant has minimized impacts to the maximum extent
practicable, will maintain riparian buffers, and will preserve approximately 9 acres of
wetland, S&EC does not believe further compensatory mitigation should be required by
the USACE.
NC-DWQ's current policy requires written concurrence for stream impacts of greater or
equal to 150 linear feet of stream length per project. We request written concurrence that
the project complies with the 401 Water Quality Certification associated with Nationwide
Permit 39. NC-DWQ's current policy does not require wetland or stream mitigation for
perennial stream channel impacts below 1 acre and 150 linear feet per project. Because
the total permanent impacts to perennial channels is less than 150 feet, we do not believe
that stream mitigation should be required by NC-DWQ. Please note that following
construction the site will contain less than 30% impervious surface. Therefore, we do not
believe that this project requires a pre-approved stonnwater plan.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
S&EC conducted a detailed wetland delineation and Neuse River Buffer evaluation on June 5,

Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent
and temporary, must be listed herein, and must be clearly identifiable on an accompanying site
plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a

VI. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
A detailed delineation was conducted in order to develop a site plan that minimized impacts.
Impact # 1 is necessary to access the area from the existing subdivision adjacent to the property.
Due to the location of the existing road east of the proposed project, this impact could not be
avoided entirely. Impacts # 2 & 3 (buffer impacts) are necessary to tie into the existing sary
sewer that will service the proposed subdivision. In addition the applicant will utilize BMP_
devices for water treatment.
VII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.

If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.ne.us/ncwetiands/stnngide.html.

wetlands will be preserved on-site, we do not believe mitigation should be required.
However, if mitigation is required, we propose payment to the WRP.

The site does not currently contain impervious surface. Following construction the site will
contain less than 30% impervious surface therefore we do not believe a pre-approved
stormwater plan is required. Moreover, because this site is located in a water supply watershed,
Durham regulations prohibit any development that exceeds 24% impervious. The applicant will
provide measures to insure that diffuse flow is achieved before stormwater enters the buffers as
well as maintain a riparian buffers. A stormwater management plan is attached for your review.

This letter will serve as confirmation of the buffer determinations made by S & E C at the subject property
referenced by the Raleigh Regional Office as NBRRO 02-014. The features represented on the Durham
County Soils and the USGS Durham East Quad maps were evaluated to determine their subjectivity to the
Neuse Buffer Rule.
There are ten stream features represented on the maps and depicted on S & E C's map as Features A through
J. Features A, B, E, G, I, and J are subject to protection under the Neuse River Basin: Nutrient Management
Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233
(NCAC 0233). These features are depicted on the map received by this Office December 19, 2001.
This letter only addresses the applicability of the Neuse Buffer Rules. For information relevant to wetland

REQUEST FOR MORE INFORMATION
Dear Mr. Radmon:
On October 24, 2003, the Division of Water Quality (DWQ) received your application dated October 24, 2003 to impact
0.19 acres of wetlands, 201 feet of stream and 24,778 square feet (W) of protected riparian buffers to construct the
proposed residential subdivision. The DWQ has determined that your application was incomplete and/or provided
inaccurate information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your application as required by 15A NCAC
2H .0506 and 26 .0233(8) and will place this project on hold as incomplete until we receive this additional information.
Please provide the following information so that we may continue to review your project.
Additional Information:
1. Wetland Impact # 2 (Design) - It appears that the triple culvert design proposed will not provide for adequate
aquatic life passage at low stream flow. Also, it appears that you are proposing to relocate the stream flow into the
wetland. Please provide additional information clearing showing how you will provide aquatic life passage, how you
will not destabilize the stream and how you will not alter the flow of the stream or wetland.
2. Diffuse Flow - All constructed stormwater conveyance outlets shall be directed to flow in a diffuse manner at non-
erosive velocities through the entire protected stream buffers without re-concentrating. If this is not possible it may
be necessary to provide stormwater facilities that are considered to remove nitrogen. Please provide a stormwater
management plan for this project. The plan shall specify all stormwater discharge points, plan details, and
calculations to indicate that diffuse flow through the protected buffers or nitrogen removal as described above will
be achieved.
3. Wetland Impact #2 (No Practical Alternatives) - You stated in your letter that "if the impacts are not approved
Durham will allow the use of a cul-de-sac in this location". As such, it appears that there is a practical alternative
that avoids the need for this crossing and it's associated impacts. Please provide additional justification as to why
this crossing cannot be avoided. A letter from the City of Durham justifying the need for the crossing may be
helpful.
Please respond within three weeks of the date of this letter by sending this information to me in writing and Mr. Steve
Mitchell of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn.

On behalf of Durham Land Associates, LLC - Durham, we hereby request authorization
from the US Army Corps of Engineers to use Nationwide Permit 39 to cover impacts to
stream channels and jurisdictional wetlands (see attached overall map). We also request
written concurrence from the North Carolina Division of Water Quality that the project
complies with the 401 Water Quality Certifications associated with Nationwide Permit
39. A Pre-construction Notification Application (PCN) is attached, which includes an
agent authorization form.
The proposed project consists of impacts from the construction of access roads and a
sanitary sewer connection for a residential housing development. The site is located on
the north side of Highway 98 and the south side of Freeman Rd (SR 1846). The project
lies between Fletcher Chapel Road (SR 1815) and Clayton Road (SR 1825) with the
southeastern property line formed by Little Lick Creek. The site is approximately 112
acres in size, and consists primarily of pine and hardwood stands. Please refer to the
attached USGS map, which displays the location of the proposed project.
S&EC conducted a detailed wetland delineation and Neuse River Buffer evaluation on
June 5, 2003. Maps were sent to the USACE on October 21, 2003 for approval. Mr.

Steve Mitchell of the NC-DWQ made a site visit and confirmed the buffers on December
4, 2001. A copy of his letter is attached.
The applicant requested a detailed wetland delineation and buffer evaluation on the
property prior to site plan development in order to avoid jurisdictional features and
riparian buffers to the maximum extent practicable. The proposed roadway will impact
approximately 0.1895 acres of jurisdictional wetlands, 132 linear feet of perennial
stream channel, and 69 linear feet of intermittent channel. These impacts are
elaborated upon within the attached PCN form and are shown on the attached inset
impact maps.
The proposed road crossing (impact # 1) is necessary to gain access for the property from
an existing road located east of the site. The road crossing will impact a segment of
intermittent channel and associated buffers. Because the road must "tie into" an existing
road east of the site, the proposed road crossing cannot be constructed perpendicular to
the stream. Impact #2 was requested by the city of Durham to meet "interconnectivity"
requirements among subdivisions. However, this impact could be avoided using a cul-
de-sac. In the past, the USACE has not always agreed that interconnectivity ordinances
justify the additional wetland impacts (i.e. the impact could be avoided). We are
requesting this impact because the city of Durham has made it a condition for PUD
approval; however, Durham has stated that if the Corps or DWQ denies the request
for impacts, they will amend the PUD to allow a cul-de-sac. The sanitary sewer
connection (impact # 3) will impact a portion of the riparian buffer in order to connect to
an existing utility line. This impact is temporary, and is a necessary utility for the
proposed development. The applicant will minimize impacts using headwalls at the
proposed crossing. Following construction, the applicant will maintain riparian buffers
on the stream channels as well as employ BMP devices to preserve water quality.
Stormwater will be treated or released as sheet flow (i.e. diffuse) before entering the
buffers. Moreover, because this site is located within a water-supply watershed, Durham
regulations will not allow >24% impervious surface within the site.
The USACE's current policy requires applicants to avoid and minimize wetland and
stream channel impacts to the maximum extent practicable and compensatory mitigation
to offset unavoidable losses of waters of the US when impacts exceed the requirements
for notification (0.10 acre). The proposed roads are necessary to access the entire
property. Because the applicant has minimized impacts to the maximum extent
practicable, will maintain riparian buffers, and will preserve approximately 9 acres of
wetland, S&EC does not believe further compensatory mitigation should be required by
the USACE.
NC-DWQ's current policy requires written concurrence for stream impacts of greater or
equal to 150 linear feet of stream length per project. We request written concurrence that
the project complies with the 401 Water Quality Certification associated with Nationwide
Permit 39. NC-DWQ's current policy does not require wetland or stream mitigation for
perennial stream channel impacts below 1 acre and 150 linear feet per project. Because
the total permanent impacts to perennial channels is less than 150 feet and a total of

S&EC conducted a detailed wetland delineation and Neuse River Buffer evaluation on June 5,
2003 Mks were sent to the USACE on October 21, 2003 for approval and to verify the
delineation. Mr. Steve Mitchell of the NC-DWQ made a site visit and confirmed the buffers on
December 4, 2001._ A copy of Mr. Mitchell's letter is attached.

VI. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
A detailed delineation was conducted in order to developa site plan that minimized impacts.
Impact # 1 is necessary to access the area from the existing subdivision adjacent to the property.
Due to the location of the existing road east of the proposed project this impact could not be
avoided entirely. Impact # 2 was requested but not required by the city of Durham to meet
"interconnectivity" requirements among subdivisions. However, this impact could be avoided
using a cul-de-sac In the past the USACE has not always agreed that interconnectivity
ordinances justify the additional wetland impacts (i.e. the impact could be avoided). We are
reguestinE this impact because the city of Durham has made it a condition for PUD
approval; however, Durham has stated that if the Corps or DWQ denies the request for
impacts, they will amend the PUD to allow a cul-de-sac. Impact # 3 (buffer impact) is
necessary to tie into the existing sanitary sewer that will service the proposed subdivision. In
addition the applicant will utilize BMP devices for water treatment.
VII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable

mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetiands/strmgide.liti-ni.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Because impacts are below the thresholds that typically require mitigation and because
approximately 9 acres of wetlands will be preserved on-site we do not believe mitigation
should be required. However, if mitigation is required, we propose payment to the WRP.
