On June 2, 2003, the Division of Water Quality (DWQ) received your request that we concur that "no written approval is
required" from the DWQ for the proposed renovation of East Cary Middle School.
You stated in the information provided with your June 2, 2003 letter, that 428 square feet (fe) (<0.01 acres) of wetlands,
40 feet of stream, and 2,005 fe of buffers (protected under the Neuse Buffer Rule) will be impacted. The wetland, stream
and buffer impacts are associated with the widening of an existing road for emergency vehicle access. The Neuse Buffer
Rule (15A NCAC 02B .0233) designates "road crossings of streams and other surface waters subject to this Rule that
impact equal to or less than 40 linear feet of riparian buffer" as "exempt". As long as the road widening does not impact
greater than 40 feet of buffer (measured parallel to the stream), then the proposed activity would be designated as
"exempt" under the Neuse Buffer Rule and will not require written authorization from the DWQ.
We assume that you are proposing to use General Water Quality Certification No. 3402 (GC3402) for the proposed
wetland and stream impacts. Condition No. 2 of GC3402 states that "Activities listed as "exempt" from these rules (Neuse
Buffer Rule) do not need to apply for written concurrence under this Certification." Therefore as long as you do not
exceed 40 feet of buffer impact and the proposed road crossing is considered "exempt", then you will not need to apply for
written concurrence under GC3402. In addition, as long as the proposed renovation results in less than 150 feet of
stream impact and all buffer impacts are considered "exempt", then you do not need to apply for written concurrence
under GC3402.
You also stated that "new stormwater will tie into existing man made conveyances, except highlighted section which
discharges to a level spreader and diffuse flows prior to entering buffer". Stormwater discharges to existing man made
conveyances has been determined to be an exempt activity under the Neuse Buffer Rule as long as there is no alterations
to the conveyances within the buffer. As long as all new stormwater is directed to existing conveyances or diffuse flow is
provided as per 15A NCAC 02B .0233(5), then no written authorization is required from the DWQ under the Neuse Buffer
Rule.
Finally, you stated on the site plan "no new impervious surface". We assume that this means that no new impervious
surface will be added to the buffer where it did not previously exist (except that associated with the road widening).
Installation of impervious surface within the footprint of existing impervious surfaces (e.g., paving an existing gravel road,
constructing a building over an existing paved parking lot, etc.) is consider an existing use exempt under the Neuse Buffer
Rule and does not require written authorization from the DWQ.
Based on the information provided within your June 2, 2003 letter and discussed above, it appears that the proposed
renovation of East Cary Middle School will not require written approval from the DWQ. However, please note that this
letter does not specifically approve any impacts to wetlands, streams or protected riparian buffers. It is simply intended to
provide you with guidance on how the proposed renovation complies with the Neuse Buffer Rule and General Water
Quality Certifications. Even though no written authorization is required from the DWQ, the renovation must still comply
with all of the conditions of the General Water Quality Certification and Neuse Buffer Rule (e.g., diffuse flow). In addition,

you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with
your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and local stormwater regulations.

The purpose of this memo is to document our discussions regarding the above named project.
As you will recall the Project Engineer (Jim Chandler of CLH Design) and I met with Todd St.
John and you to discuss this project and how to handle stormwater in a fashion that complies
with the buffer rules. The enclosed plans reflect the final stormwater plans and were revised as
per our meeting. On 5/19/03, John Domey, you and I also discussed the minor impact required
to widen an existing road for emergency vehicle access at the site (see attached plan). You
agreed that this was an exempt activity under the buffer rules and therefore a PCN was not
required for a 401 or buffer approval.
Before Land Quality will resume processing the erosion control permit, they have requested that
you notify them that no written approval is required for the work on-site. Will you please
contact John Holley regarding this matter?

This letter will serve as confirmation of the buffer determination made by S&EC at the
subject property referenced by the Raleigh Regional Office as NBRRO 02-229.
On September 9, 2002, I conducted a site visit of features A & B involved in the above
referenced project as identified on the attached maps. It was determined that the features shown
on the Wake County Soil Survey, but absent on the USGS Cary, NC Quad map could potentially
be subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management
Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:
02B.0233 (NCAC .0233). Feature A is subject and starts at flag 120. Feature B is subject and
starts at flag 55.
This letter only addresses the applicability of the Neuse Buffer Rules. For information
relevant to wetlands and other impacts, please contact the Central Office at 733-1786. Thank yo u
